Mississippi Woman Suffers as a Result of Mirena IUD Migration

Mirena IUD Side Effects LawsuitMississippi plaintiff Breona Johnson has filed a lawsuit against Bayer Healthcare Pharmaceuticals Inc. for their levonorgestrel-releasing intrauterine device known as the Mirena IUD. Ms. Johnson is now bringing allegations that as a direct result of Bayer’s Mirena IUD, she suffered severe abdominal pain and eventually migration of the intrauterine device. 

The plaintiff had the Mirena IUD inserted in March 2009 and followed all instructions as directed by her physician. In January 2013, plaintiff went back to her physician to remove the Mirena IUD, but the attempts to remove the device were unsuccessful. Finally, Ms. Johnson underwent hysteroscopic removal of the Mirena IUD after prolonged pain and suffering. 

Overview of the Mirena IUD

The Mirena IUD is a contraceptive device that is inserted into a woman’s uterus by a physician. Bayer submitted a “New Drug Application for Mirena” to the U.S. Food & Drug Administration (FDA) in December 2000. Today, the Mirena IUD has been used by more than 15 million women worldwide. Bayer itself has admitted to not knowing “exactly how Mirena works” but explains that the Mirena IUD may inhibit sperm movement and reduce sperm survival to reduce the chance of pregnancy. The Mirena IUD is intended to be inserted and effective for up to five years, but there is no warning about the Mirena IUD spontaneously migrating after insertion. 

Mirena IUD Lawsuits Grow

Currently, there are estimated to be more than 370 Mirena IUD lawsuits filed in state and federal courts alleging spontaneous migration of the device. Each lawsuit blames Bayer for its lack of warnings while exaggerating the Mirena IUD’s benefits and downplaying its risks. The plaintiffs argue that this kind of behavior is unacceptable when a person’s well-being is at stake. The FDA alone has reportedly received more than 70,000 complaints regarding the Mirena IUD. In 2009, the FDA even issued a warning to Bayer regarding the misleading labels. 

The Mirena IUD lawsuit is Breona Johnson v. Bayer Pharmaceuticals Inc., Case No. 4:13-cv-00156-SA-JMV, in the U.S. District Court for the Northern District of Mississippi.
