Lawsuit Seeks Cancer-Related Damages from Asbestos Companies

Mesothelioma Asbestos LawsuitJames Rhodes and his wife Pamela Rhodes have sued a number of companies involved in the mining, processing and deployment of asbestos products, alleging that these companies’ actions led to James Rhodes developing various asbestos-related diseases. 

Per the asbestos exposure lawsuit, Rhodes developed malignant mesothelioma, a type of cancer closely associated with asbestos exposure. He was diagnosed with mesothelioma in August of 2013. Mesothelioma is fatal, and almost universally associated with exposure to the mineral.

The asbestos lawsuit states that starting in the late 1960s, Rhodes worked in a boiler room as a powerhouse mechanic and other related occupations. According to the lawsuit, boiler equipment and other materials involved in the case is known to release asbestos fibers and dust, invisible to the naked eye. The asbestos lawsuit further asserts that this exposure caused Rhodes’s later asbestos-related cancer. 

The mesothelioma lawsuit alleges that during this time period, the manufacturer of the equipment that Rhodes used did not warn the public about the risks of asbestos exposure associated with their equipment, and that they were guilt of “often failing to issue any warning at all, despite the fact that these asbestos companies knew that breathing small amounts of asbestos dust could be fatal.” 

Additionally, the mesothelioma lawsuit states that scientists and regulators now unanimously agree that any level of asbestos exposure can cause cancer, just like the mesothelioma Rhodes developed in 2013. 

Rhodes’s lawsuit names dozens of companies involved in getting asbestos from the ground in its natural mineral state, all the way to the boilers and other equipment Rhodes worked with. This includes mining companies, processing plants, and boiler manufacturers, as well as their successor corporations. The case seeks damages related to Rhode’s illness and the cost of the lawsuit. 

The case is formally titled James Nathan Rhodes and Pamela Susan Rhodes, his spouse vs. 3M Company, Formerly-Known-As Minnesota Mining and Manufacturing Company, et al, Case No. 1:13-cv-864, filed in the United States District Court for the Middle District of North Carolina.
