Lawsuit Says Propecia Diminished Plaintiff’s Quality of Life

In March 2013, a new lawsuit was filed against Merck & Co., in which the plaintiff alleged that Merck failed to warn about the serious and long-lasting sexual side effects of Propecia.
Propecia (finasteride) is a drug that is manufactured by Merck to treat men with male pattern baldness. This plaintiff, a man from Arizona, is seeing more than $75,000 in damages. The plaintiff claims that he had used Propecia for roughly a year and a half to treat his male pattern baldness, after which time he suffered serious injuries including loss of libido, orgasm disorder, fatigue, depression, ejaculation disorder and anxiety. Prior to using the drug, he had not had any of these issues.
This plaintiff is not the first to complain about long-lasting Propecia sexual side effects. Men all over the world have suffered significant sexual side effects after using Propecia. There are currently hundreds of Propecia lawsuits that are pending in the United States. Last year, the U.S. Judicial Panel on Multidistrict Litigation consolidated all of the pending Propecia lawsuits into multidistrict litigation (MDL) in a New York federal court.
Plaintiffs Claim Merck Failed to Adequately Warn of Propecia Side Effects
After Propecia was approved by the U.S. Food & Drug Administration (FDA) in 1997, Merck spent close to $200 million on direct-to-consumer advertising campaigns. Intrigued by the persuasive ads that promised to put an end to their receding hairlines, thousands of men asked their doctors for a Propecia prescription. The sales of Propecia surpassed $447 million in 2010. Although the drug was shown to be effective at combatting hair loss, many men found they suffered significant sexual side effects that severely diminished their quality of life.
The plaintiff in this lawsuit claims Merck was aware of the sexual side effects finasteride and Propecia but failed to warn consumers about the risks. The plaintiff also alleges Merck downplayed the risks and falsely claimed that any sexual side effects would stop once the patient discontinued use of the drug.
Despite the complaints about persistent Propecia sexual disorders, Merck did not update its label to include warnings until 2012. However, Merck had added warnings to products they sold in other countries. The Swedish Propecia label was updated in 2008 to include warnings about the potential for users to experience persistent sexual side effects even once the use of the product was discontinued. Labels in other European countries were also updated to include a warning of the potential for long-term Propecia side effects.
