CVS, Walgreens opioid crisis class action settlement overview:

  • Who: CVS Pharmacy and Walgreens agreed to pay around $5 billion each to resolve thousands of claims that they exacerbated the nationwide opioid crisis.
  • Why: CVS and Walgreens were accused of exacerbating the opioid crisis with their sale of prescription narcotics.
  • Where: The opioid crisis is nationwide.

CVS Pharmacy and Walgreens have each agreed to pay around $5 billion to resolve thousands of claims they exacerbated the nationwide opioid crisis with their sale of prescription narcotics.

CVS revealed in its quarterly earnings report that it has tentatively agreed to pay $4.9 billion to states, cities and counties over a 10-year period after the pharmacy said it mediated the claims with state attorney generals and multidistrict litigation (MDL) lawyers last month.

Additionally, CVS — which is not admitting to any wrongdoing — announced it will pay Native American tribes a total of $130 million dollars over the same course of 10 years.

Walgreens, meanwhile, revealed in a filing with the Securities and Exchange Commission (SEC) it has agreed to pay $4.8 billion to states in addition to nearly $155 million to Native American tribes over the course of 15 years.

States and local government still must sign off on settlements

States and local governments are still required to sign on to the proposed settlement agreements before they can become official, Law360 reported.

Previous settlements totaling $26 billion have reportedly already been made to resolve claims brought against Cardinal Health Inc., Johnson & Johnson, McKesson Corp. and AmerisourceBergen Corp.

CVS and Walgreens — along with Walmart — were given a temporary reprieve last month from having to abide by business practice requirements imposed on them by a federal judge who found they were liable for painkiller prescriptions the pharmacies filled in Ohio’s Lake and Trumbull counties.

CVS, Walgreens and Walmart have also been ordered to pay $640 million towards an abatement plan being put in place in the two Ohio counties — pending the end of the current injunction.
