California Plaintiff Files New Yaz/Yasmin Lawsuit

Yaz/Yasmin lawsuit litigation is going full steam as new lawsuits continue to be filed by plaintiffs alleging adverse side effects resulting from use of the birth control pills. On September 6, 2012, one such Yaz lawsuit against the manufacturers of Yaz and Yasmin was filed in Superior Court, Los Angeles County. The Yaz lawsuit was filed by plaintiff Lucie Skalova.
The Yaz lawsuit by Skalova accuses Bayer of 11 counts of negligence, claiming that the pharmaceutical giant failed to both adequately test the two birth control drugs, Yaz and Yasmin, before bringing them to market. The Yaz lawsuit also claims that the company did not give proper warnings to both the public and medical community as to the dangers posed by use of the drug.
Bayer Forced to Correct Misleading Ads as More Yaz/Yasmin Lawsuits are Being Filed
Skalova’s Yaz lawsuit complaint alleges misleading commercials aired by Bayer tricked consumers into believing the effectiveness and safety of their products and their superiority over alternative oral contraceptives on the market. She made reference to Bayer’s agreement to pay $20 million to redo the commercials.
Despite Severe Side Effects, There is Still No Recall on Yaz or Yasmin
Yaz, as well as its last-generation counterpart, Yasmin, contain drospirenone, which is proven to cause blood clots. A study commissioned by the FDA reported patients who used oral contraceptives containing drospirenone doubled their side effect risk of developing blood clots over other birth control pills.
A discussion soon followed to decide whether or not to recall Yaz and Yasmin. It was decided by the panel not to recall the drugs, but reinforce the elevated side effect risks of Yasmin and Yaz blood clots by updating the label with stronger warnings. After the vote, four women’s groups consolidated their efforts in a written protest to the FDA, indicating they have endangered the lives of women by keeping the drugs on the market.
Yaz and Yasmin Lawsuits Filed Over Blood Clot Injuries
Over 1,200 women have filed Yaz/Yasmin lawsuits alleging adverse side effects from Yaz and Yasmin. These side effects include blood clots, strokes, deep vein thrombosis, pulmonary embolism, and gallbladder disease. Bayer has already paid out over $402 million in Yaz lawsuit settlements with an additional $610.5 million set aside for future settlements, as thousands of Yaz and Yasmin lawsuits are still pending. These Yaz and Yasmin lawsuits are spread out over various courts, including a multidistrict litigation (MDL) consolidation in the Southern District of Illinois and a Mass Tort in New Jersey; other cases are pending in Pennsylvania and California.
