Bayer Accused of Overstating Benefits of Mirena IUD
By Anne Bucher
The Mirena IUD, manufactured by Bayer, is a long-lasting contraceptive device that is implanted in the uterus. The U.S. Food & Drug Administration (FDA) approved the Mirena IUD in 2000. Due in part to an aggressive marketing campaign, the Mirena IUD skyrocketed in popularity. Since it was approved by the FDA, more than 10 million women have used the Mirena IUD. Many women were drawn to the IUD because it is effective for up to five years. However, an increasing number of women are complaining about serious Mirena IUD side effects.
Thousands of Women Have Suffered Serious Mirena IUD Side Effects
The FDA has received more than 45,000 complaints about Mirena IUD side effects. The most frequent complaints include:
- The woman’s body rejecting/expelling the Mirena IUD
- Abdominal pain
- Uterine perforation
- Organ perforation
- Pelvic inflammatory disease
- Migration of the Mirena IUD
When the Mirena IUD migrates within the body, it can lead to serious complications, including uterine perforation and organ perforation. When device migration occurs, corrective surgery is required. These Mirena IUD complications can have long-lasting implications.
FDA Warned Bayer about Overstating Mirena IUD Benefits
Bayer began marketing the Mirena IUD to “busy moms,” claiming that the device would help improve their sex lives and make them “look and feel great.” A large part of the marketing campaign involved Mirena IUD “parties,” promotional events that were held in a consumer’s home or other private setting. At these Mirena IUD parties, which included a presentation by a nurse practitioner, a representative would follow a promotional script designed to appeal to mothers. The representative encouraged consumers to consider the Mirena IUD because it could “help couples keep life simple.”
The FDA issued a warning letter in 2009, reprimanding Bayer for overstating the benefits of the Mirena IUD. The agency found that the script used in the Mirena IUD parties suggested that the device would “result in increased levels of intimacy, romance, and by implication, emotional satisfaction.” The letter stated that, in reality, many Mirena IUD users reported a decreased libido and a number of other uncomfortable side effects.
Number of Mirena IUD Lawsuits Continues to Rise
Numerous women who have suffered severe Mirena IUD complications are choosing to sue Bayer for their injuries. They claim that the company overstated the benefits of the Mirena IUD and failed to provide adequate warning about the dangers of uterine perforation and other complications. In many cases, the women have been faced with high medical and rehabilitation costs associated with repairing the damage caused by the Mirena IUD. They are seeking compensatory and punitive damages. They also seek to hold Bayer accountable for failing to warn about the significant health complications associated with the device.
