Actos Bladder Cancer Lawsuit Filed By Woman Who Took Actos for Three Years

By Sarah Pierce

Actos pills cause bladder cancer alleges side effect lawsuitA Kentucky woman who developed bladder cancer after taking the diabetes drug Actos has filed an Actos bladder cancer lawsuit against Takeda Pharmaceuticals and Eli Lilly & Co. alleging they were negligent and/or fraudulent with manufacturing and marketing the drug, which had a direct negative impact on the her health and well-being. Her lawsuit is one of many Actos bladder cancer lawsuits pending in the Actos multi-district litigation called In re: Actos (Pioglitazone) Products Liability Litigation (MDL No. 2299).

According to the bladder cancer lawsuit, the Kentucky woman was prescribed Actos and took the diabetes drug from 2007 to 2010. She developed bladder cancer sometime in July 2009. Her Actos lawyer alleges in the lawsuit that the Plaintiff suffered several adverse side effects as a result of the defective drug, including: severe mental and physical pain and suffering; past and future permanent injuries and emotional distress; economic loss due to medical expenses; and living-related expenses as a result of a new lifestyle. Her Actos bladder cancer lawsuit alleges she never would have taken Actos and been harmed if Takeda and Eli Lilly had taken the proper measures to warn her and other consumers about the dangers associated with Actos, in particular the increased risk of developing cancer after taking the drug from more than a year.

This increased risk has been documented in several Actos bladder cancer studies and by the U.S. Food and Drug Administration (FDA), which warned users in June 2011 that taking Actos for more than one year could increase their risk of developing bladder cancer by 40% compared to non-users. Taking Actos for more than two years could increase the risk of bladder cancer by as much as 83%, according to researchers at McGill University in Montreal. The McGill University study, published May 31, 2012 in the British Medical Journal, was the first to propose a reason why this risk exists. According to McGill researchers, a possible explanation for the Actos bladder cancer risk is chronic irritation of the bladder from crystal formations caused by the diabetes drug. This irritation can lead to the formation of bladder tumors and eventually bladder cancer. However, further research on the link between Actos and bladder tumors and cancer will be needed to establish this as a true cause, researchers warned.

Takeda & Eli Lilly could face as many as 10,000 Actos bladder cancer lawsuits in the U.S., according to a March 13, 2012 article from Bloomberg News. So many Actos bladder cancer lawsuits have already been filed that a federal Judicial Panel has consolidated them into one federal court in Louisiana as part of the Actos lawsuit MDL known as In Re: Actos Products Liability Litigation (MDL No. 2299). The Actos lawsuit MDL makes it easier for victims of Actos bladder tumors and cancer to file a lawsuit against the drug makers seek compensation for the severe physical and mental pain, permanent injuries, and economic loss due to medical expenses and living expenses as a result of a new lifestyle. The majority of Plaintiffs in Actos bladder cancer lawsuits allege Takeda and Eli Lilly knew about the risk of Actos bladder cancer but chose to hide it from the public in order to continue selling the drug and make a profit.
