$9 Million Mesothelioma Settlement Awarded to Dow Chemical Worker
By Andrea Gressman
Henderson’s story is tragic, but fortunately for those he left behind, it is also victorious. Represented by an American mesothelioma law firm, Henderson’s family received a $9 million asbestos lawsuit settlement for charges against Dow Chemical.
While money is no restitution for a lost life, the Henderson family’s success gives hope to other employees and their families whose health has been similarly affected through corporate negligence and asbestos exposure. Given that Henderson worked for years for companies where exposure to asbestos was likely, it is noteworthy that the mesothelioma lawyers that represented the Henderson family were able to prove that his cancer was, indeed, caused by exposure to asbestos at Dow Chemical.
It comes with no surprise then that Henderson was. According to one of the family’s mesothelioma lawyers, Henderson is “one of many [Dow Chemical] workers who . . . came down with an asbestos cancer.”
According to the mesothelioma lawsuit documents, Mr. Henderson spent a great deal of his career working closely with products that had asbestos in them. The mesothelioma lawsuit plaintiff worked at Dow Chemical as one of their contract employees. During that time, Mr. Henderson was repeatedly exposed to asbestos as an innocent bystander to the insulators Dow had on their premises.
With Dow Chemical being one of the largest chemical manufacturing plants around the world and being responsible for thousands of employees, it is possible that thousands of these employees were exposed to the same asbestos that Mr. Henderson was exposed to.
Asbestos is a human carcinogen with a latency period between 20 to 50 years. When products containing the toxin are disturbed in any manner, workers are at risk for asbestos exposure, which leads to the side effect of mesothelioma. Exposure can be experienced by inhalation of the asbestos, the most common means of exposure. Employees who work in facilities containing asbestos, therefore, are at risk for developing mesothelioma when they are inadvertently exposed to asbestos particles. Malignant mesothelioma, or also referred to as “asbestos cancer,” is considered rare among other types of cancer. The disease targets the body’s mesothelium, the thin layer of cells that lines the body’s internal organs. Pleural mesothelioma is the most common of the three mesothelium cancers, and occurs in the lining of the lungs.
