21-Year-Old Mirena IUD Victim Sues Bayer

Mirena IUD migration lawsuitChristina Ramirez was only 21 years old when she opted for the popular Mirena IUD for birth control. Six years later, she’s filed a lawsuit against the manufacturer, claiming that she wasn’t warned of sporadic migration that might result in pain, suffering and lifelong Mirena side effects. 

A Nebraska resident, Ramirez the Mirena IUD implanted around Christmas in 2007, according to the Mirena lawsuit. As required, shortly after implantation her doctor checked for placement and everything seemed to be in order. While Bayer warns against punctures happening during insertion, there’s no mention on any materials of IUD migration post-implantation. However, two years later during an abdominal x-ray, it was revealed that the Mirena IUD had perforated the uterus and migrated next to her colon. Ramirez filed her Mirena lawsuit on August 2, 2013.

The migration required a laparoscopic IUD removal surgery shortly after getting the x-ray in 2009. In the midst of this turmoil, Ramirez also became pregnant since the IUD wasn’t where it was supposed to be. Very few IUD pregnancies are viable, since they’re rare and when they do happen, they’re usually ectopic.


Ramirez was an exception. Her lawsuit states that “although (she) followed all instructions accompanying the Mirena and used the Mirena as directed, after implant…she suffered serious side effects and life-threatening side effects and injuries, including but not limited to abdominal pain, surgical removal of the Mirena and related sequelae requiring hospitalization, an unplanned pregnancy, prenatal care, and childbirth, medical therapy, continuing treatment and medical monitoring.” 

As a result of her faulty Mirena, Ramirez endured pain and suffering, bodily impairment, mental anguish and diminished enjoyment of life. She claims that Bayer, “misrepresented and continues to misrepresent to the public, and to the medical profession…that the Mirena is safe and free from serious defects and side effects, and (Bayer) has fraudulently concealed facts and information that could have led” to Ramirez discovering the side effects of Mirena sooner. 

Instead, she was led to believe that the IUD implantation was successful and otherwise shouldn’t suffer complications. This wasn’t the case, and now not only does Ramirez suffer lingering side effects, she also has a lifetime of care ahead of her from the unplanned pregnancy – even though she was responsible in opting for the safest form of birth control besides abstinence.

The Mirena Lawsuit Allegations

Ramirez is suing Bayer for defective manufacturing, design defect, negligence, failure to warn, strict liability, breach of warranty, negligent and fraudulent misrepresentation, fraud by concealment and violation of the Nebraska Consumer Protection Act. She’s seeking past and future general damages, past and future economic and special damages, loss of earnings and impaired earnings capacity, past and future pain and suffering damages, equitable relief, declaratory judgment, medical monitoring and cost of suit.

Like other Mirena victims, Ramirez will receive a trial by jury and may be awarded any other damages the court deems necessary. Compensation won’t make up for pain and suffering, not to mention the financial and emotional burden of a child from a pregnancy Ramirez did her best to prevent. However, the option of joining a Mirena class action lawsuit might make the process easier.

The case is Christina Ramirez v. Bayer Healthcare et al., Case No. 13-cv-02107, the United States District Court for the District of Minnesota.
