$10M Children’s Tylenol Stevens Johnson Syndrome Settlement Upheld

Brianna Maya has become a well-known face for Stevens Johnson Syndrome as this young girl has been forced to fight for her life and deal with the severe SJS side effects for most of her life now. She developed SJS at the age of three when her mother unsuspectingly used Children’s Tylenol and Children’s Motrin according to the doctor’s instructions, alternating each every three hours, in order to treat Briana’s fever.
After Brianna developed Stevens Johnson Syndrome her parents sued the manufacturer, Johnson & Johnson subsidiary McNeil Consumer Healthcare, alleging they did not properly warn patients about the side effect risk of developing Stevens Johnson Syndrome. As a result, Brianna Maya and her family were awarded $10 million and it was recently reported that this settlement has been upheld.
Briana’s Stevens Johnson Syndrome symptoms started out as a skin rash and redness around her eye area. However, this turned into blisters both on the outside as well as the inside of her body. These injuries encompassed over 80% of her body. It caused her to experience damage to her organs and now one eye is blind. She also has scars all over her skin. Brianna had to endure multiple eye surgeries and she has also developed seizures due to this terrible condition.
Briana and her family received their $10 million award by a jury in 2011. The jury found that Johnson & Johnson did not provide a proper warning of the side effect risk of developing Stevens Johnson Syndrome from taking Children’s Tylenol and Motrin. However, Johnson & Johnson filed an appeal of the significant award amount. But after a Philadelphia judge reviewed the Stevens Johnson Syndrome lawsuit and found that there were no legal errors in the case, the award was upheld.
Stevens Johnson Syndrome and toxic epidermal necrolysis (TEN), which is the more severe form of SJS, can develop as a reaction to many different types of drugs. It affects the young and old and can occur whether or not the patient has taken the medication previously without a negative response or it is the first time a patient takes that particular medication. Both SJS and TEN are life-threatening and have severe consequences.
As a result of developing Stevens Johnson Syndrome and toxic epidermal necrolysis, many victims have opted to file either a TEN lawsuit or SJS lawsuit in order to receive compensation for the injuries they have sustained, the medical expenses they have incurred, as well as their lost wages.
