Chopt finger salad lawsuit overview: 

  • Who: Allison Cozzi filed a lawsuit against Chopt Creative Salad Co. LLC and other related entities. 
  • Why: Cozzi claims Chopt served her a salad contaminated with a portion of a human finger at a restaurant in Mount Kisco, New York. 
  • Where: The lawsuit was filed in the Supreme Court of the State of New York, County of Westchester. 

A New York woman claims she bit into a severed finger earlier this year while eating a salad she had purchased from an area Chopt Creative Salad Co. restaurant. 

Plaintiff Allison Cozzi argues an employee at a Chopt restaurant in Mount Kisco, New York, cut off a portion of their left pointer finger while chopping arugula earlier in the day she allegedly bit into a finger while eating her salad in April. 

“Shortly after plaintiff purchased the salad, while she was eating the salad, she realized that she was chewing on a portion of a human finger that had been mixed in to, and made a part of, the salad,” the Chopt lawsuit states. 

Cozzi claims Chopt was, among other things, reckless, careless and negligent for allegedly providing her with food that was “contaminated and adulterated with a foreign object consisting of a portion of a human finger.” 

Chopt pays fine following investigation by area health department, lawsuit says

Following an investigation, Cozzi claims Chopt received a ticket from the Westchester County Department of Health for allegedly violating state rules and regulations requiring the owners and operators of a food establishment to “operate their premises in such a way as to avoid imminent health hazards.” 

Cozzi, who is requesting an award of damages, argues Chopt did not contest or appeal the health department’s alleged violation ticket and ultimately paid a fine assessed to the restaurant. 

As a result of the alleged incident, Cozzi claims she sustained “severe and serious” personal injuries, including shock, panic attacks, migraine, cognitive impairment, traumatic stress and anxiety, nausea, vomiting, dizziness and neck and shoulder pain. 

In other news involving contaminated food, grocery store Trader Joe’s recalled thousands of its Unexpected Broccoli Cheddar Soup in July over concerns the product had been contaminated with insects.
