The Walt Disney Co. is facing a class action lawsuit stating that the area around its pool at its Aulani Resort in Kapolei, Hawaii, is dangerously slippery.

Disney has known about the dangers of the pool area surface since at least 2013 but has not applied an anti-slip surface or done proper maintenance on the area in order to prevent guests from slipping, falling and injuring themselves, the class action lawsuit argues.

“… It should provide adequate warnings prior to and at the time of their arrival that its grounds are particularly slippery and that it has failed to apply anti-slip products and/or technology on the ground to decrease the likelihood of slips and falls,” the class action claims.

Scott and Danielle Thompson, along with their then 10-year-old child, visited the resort in March, and their child slipped and fell in the area around the Waikolohe Pool on the first day of the trip, leading to an emergency room trip and stitches to close a wound on the back of the child’s head, the Disney Aulani pool class action says.

Hospital, TripAdvisor note multiple slip-and-fall accidents in pool area, lawsuit claims

Emergency room medical provider Lauren Pangle at the The Queen’s Medical Center-West O’ahu told the Thompsons that the hospital has seen multiple children who slipped and fell at Disney’s Aulani pool, according to the lawsuit.

Multiple reviews of the resort on TripAdvisor also noted multiple slip-and-fall accidents in the pool area related to the slippery surface, the lawsuit says.

Tickets to Disney World and Disneyland both recently saw price increases across many tiers.

Yes! On June 26, 2023 I fell and hurt my chest and ribs while walking in the Disney pool area. Employees witnessed and did nothing to help. There was no postings or warning signs anywhere and the pool area was overcrowded.
