Derailed trainA train injury case recently ended with a big award for the victims, according to news reports. According to Yahoo Finance, this was the first trial of several filed against Amtrak after the Washington state derailment; dozens more are set to be processed through the court system in the next year and a half.

The jury in this first Amtrak derailment train injury case gave $16.75 million in damages to those plaintiffs harmed in the 2017 accident. That accident hurt more than 60 passengers, community members on the road near where the derailment occurred, and crew members.

The damages in this particular train injury case broke down to awards for each of the two plaintiffs, who were passengers on the train, and one award recognizing the influence that the incident had on one of the plaintiff’s marriages.

One of the victims reportedly sustained a traumatic brain injury that still affects his life today. He also suffered from liver and kidney lacerations, a spinal fracture, and a broken pelvis.

The derailed train car reportedly caused significant damage and wreckage when the car fell off of an overpass. The other plaintiff in this early case was driving a truck on Interstate 5 when the train car fell. He claims that he was stuck inside his car in serious pain for well over an hour.

After he was rescued from the scene, it was discovered that he had far-ranging injuries, including anxiety, behavior changes, personality issues, and multiple broken bones, all of which contributed to his reduced ability to work.

A report released by the National Transportation Safety Board some time after the accident showed that the Amtrak train was traveling at a very fast rate of speed considering the current conditions. The maximum speed on the curve should have been 30 miles per hour, but the derailed car mentioned in the train injury case was going at least 80 miles per hour at the time of the crash.

A growing number of victims who were hurt in that crash have stepped up to accuse Amtrak of not properly implementing the right safety protocol and arguing that the accident could have been easily prevented.

Since the release of the government report, Amtrak has admitted their negligence. After that point, company representatives reiterated that the primary concern would be in determining reasonable and fair compensation for the victims.

It’s believed that more than 35 people have filed lawsuits against Amtrak for damages associated with the Washington state accident. These victims claim that there were numerous risk mitigation strategies that Amtrak could have put into place to reduce the life-changing impacts victims are now coping with both personally and professionally.

According to KUOW, the Amtrak accident happened on the very first day of what was set up to be a more regular schedule between Portland and Seattle. The fateful trip was supposed to be one of six in the new schedule on a new Tacoma-based route, but company representatives from Amtrak have stated that until their new trains can meet the latest safety standards that travel will remain on the older route, which has more congestion.
