Generac generators class action lawsuit overview: 

  • Who: Joe Juliano filed a class action lawsuit against Generac Holdings Inc. 
  • Why: Juliano claims Generac manufactured and sold generators that could expel fuel when opened, which posed a fire and burn hazard and prompted a recall earlier this month. 
  • Where: The class action lawsuit was filed in North Carolina federal court. 

Generac manufactured and sold defective generators that can expel fuel when they are opened, presenting both fire and burn hazards, a new class action lawsuit alleges. 

Plaintiff Joe Juliano claims Generac recalled around 64,000 units of several models of Generac Portable Generators earlier this month over their allegedly defective and dangerous nature. 

Juliano argues the recalled Generac generators fail to vent adequately from their rollover valve, an issue that causes their gas tank to build up excess pressure and ultimately expel fuel when they are opened. 

“To date, Defendant Generac has received reports of 27 incidents of the generators overheating and pressurizing or expelling fuel when opened, including three incidents resulting in severe burn injuries,” the Generac class action states. 

Juliano wants to represent a nationwide class and North Carolina subclass of consumers who purchased a Generac Portable Generator that was included in the recall. 

Plaintiff suffered chemical burn after being doused in gasoline by Generac Portable Generator, says class action

Juliano claims he suffered a rash, skin irritation, and a chemical burn after he was doused with gasoline while attempting to relieve “excess pressure that had accumulated in the gasoline tank” of the Generac Portable Generator he purchased to power equipment in his ice cream trailer. 

“Plaintiff has lost, and continues to lose, money because the Defendant’s dangerous and defective Generator shuts down at events, thus leaving Plaintiff unable to operate his ice cream trailer/truck without the Generator,” the Generac class action states. 

Juliano claims Generac is guilty of unjust enrichment, fraudulent concealment, fraud by omission, breach of implied warranty of merchantability, breach of express warranty, negligent design defect, and negligence, and of violating the Magnuson-Moss Warranty Act

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, general, special, incidental, statutory, punitive, and consequential damages for himself and all class members. 

A separate class action lawsuit was filed against Generac earlier this year by a consumer claiming the company sold dangerous and defective solar panel PWRcell Systems.

    So I bought this generator, very excited to own a Generac as I’ve always heard it was a good company. Well unfortunately this was not what I got, I got a GP15000E August, 2022, the first thing I noticed about a month into running it, it likes to rev the engine over and over. Then the gas tank started to blow up like a balloon then it would shut down and stop running. I then would have to open the gas cap and let all the hot fumes out of the tank. Thank goodness it shut down because if that tank was too burst I could only imagine what would happen to all the fuel on the hot generator. So I call them to get it serviced, well they gave me the info I needed to get it worked on and come to find out there warranty company does not work on portable generators, so then, after some time I call them again, now they want me too drive 4hours to one of there facilities to get it fixed, mind you this runs my business and can’t be down for long as it is my bread and butter for my family of 7. They refuse to give me a loner and will probably have it for a week+, then that week goes by and they tell me it’s fixed. So I take it home just to find out it still does not work properly, so I call them again and basically tells me to take back if I want it fixed. With no other options, I take it back to them. Another week plus goes by. They call me to tell me it has been repaired and this time I tell them to make sure they run a load on it before I drive out there to pick it up. They told me they did and everything is perfect so I make my short drive in my 3500 dodge diesel to pick it up again, get home……… just for it not to work properly and now it has sat in my garage ever since because I felt robbed and lost on what too do next. It is really sad that’s how they run there operation, there customer service is just awful I’ve had probably 30+ conversations and my last call was literally the worst, as I was trying to talk them into taking some responsibility on there product, the lady said, well what would you like us to do about it? WOW REALLY! Maybe give us working product! That was the last conversation I had with Generac.

    The manual clearly states to let the generator cool down before refueling. Open the gas Cap slowly. I’m tired of stupid people suing manufacturers for being stupid and now I have to pay more for a generator because of lawsuits. I am ready to start suing people for being stupid and costing me more money. I think I can get 12 jury members to agree with me. You have to think about what you are doing. People have no common sense anymore and want someone else to pay for their mistakes. Sad, sad, sad.

      Reading the owners manual before operating any equipment. You have to consider, people don’t read the owners manual for a new car. Then sue after a accident. People are sue happy and we all pay for it. Sorry can’t fix stupid.
