A website has been established that informs Class Members of their rights under an Ocean Spray artificial flavoring class action settlement.
Though the website is live, the settlement is not accepting claims at this time. A judge has yet to approve the settlement deal. Top Class Actions will provide information on how to file a claim as soon as the details are available.
Until then, viewers interested in updates to the Facebook ad class action settlement can sign up for email notifications when information is updated by creating a free Top Class Actions account and clicking “Follow Article” at the top of the post.
The website explains that Ocean Spray denies the allegations and maintains that the company did not commit any wrongdoing.
However, Ocean Spray agreed to pay a $5.4 million settlement to end claims that the company falsely advertised its juice products as containing “no artificial flavors.” The company reportedly agreed to settle in order to avoid the potential costs and risks associated with further litigation.
Class Members include those people who purchased certain Ocean Spray products between Jan. 1, 2011 and Jan. 31, 2020 for personal or household use. A full list of the covered products is available here.
According to the website, no benefits are available yet but Class Members will be able to file a claim for benefits beginning on Feb. 15, 2020. The website explains that claim forms must be submitted by July 10, 2020 if completed online. Class Members can also mail in a claim form and must postmark it by July 10, 2020.
Class Members who file a valid claim by the deadline are eligible to receive $1 for each bottle of Ocean Spray purchased. Households can receive up to $20 in benefits from the Ocean Spray class action settlement.
The Ocean Spray class action settlement website explains that the rights of all Class Members are affected by the settlement, even if they choose to not submit a claim.
Class Members who remain in the Class either by submitting a claim or by doing nothing will give up their right to pursue independent litigation against Ocean Spray over the alleged false advertising issue. Those who do nothing should be aware that though they give up their rights to pursue litigation, they will not receive benefits. Class Members must submit a claim form to receive benefits.
Class Members also have the right to exclude themselves from the Class, which will prevent them from collecting benefits from the settlement but lets them preserve their right to pursue independent litigation against Ocean Spray. The deadline for Class Members to exclude themselves from the Class is July 1, 2020.
Consumers have the right to object to the settlement by writing to the court about their objection. The deadline to object to or comment on the settlement is July 1, 2020.
Class Members who do not exclude themselves from the Class also have the right to make an appearance and speak about the Ocean Spray class action settlement in court. Class Members can attend the final approval hearing scheduled for July 31, 2020.
