A website has been created for a recently certified Class of consumers allegedly affected by an appraisal scheme carried out by Countrywide, Bank of America, and LandSafe.

The website has been established for Class Members to read about the class action lawsuit and consider their rights.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Plaintiffs Barbara Waldrup, Elizabeth Williams, Becky Reaster, and Rebecca Murphy filed two class action lawsuits against Countrywide and Bank of America alleging that the mortgage lenders failed to meet legal requirements and appraisal standards such as the Uniform Standards of Professional Appraisal Practice (USPAP).

USPAP requires appraisals to be conducted independently and competently, and for the results of appraisals to be communicated truthfully and in a manner that is not misleading. This means that reporting a predetermined result for compensation is unethical under USPAP appraisal requirements.

Countrywide allegedly entered into an unlawful scheme with LandSafe Appraisal Services Inc., which allowed LandSafe to charge $300 to $500 for their residential real property appraisals despite never completing these appraisals.

Plaintiffs argue that Countrywide entered the scheme in an attempt to close as many loans as possible to maintain “heavy profit margins.”

“Because the legally-mandated USPAP appraisal had the potential to delay or terminate a prospective loan transaction and, thus, limit Countrywide’s ability to securitize and sell such loans to Wall Street, Countrywide opted for a different course of action,” plaintiffs claim in their Countrywide class action lawsuit.

“Countrywide and LandSafe agreed to knowingly, fraudulently, systematically and uniformly produce phony so-called USPAP ‘appraisals’ on home loans originated by Countrywide which were not performed in accordance with required USPAP standards.”

The court recently certified a Class of consumers who received an appraisal from LandSafe in connection with a Countrywide loan between Jan. 1, 2003 and Dec. 31, 2008. A state Class of the same consumers from Texas was also certified.

The Classes were found to comply with federal Class certification requirements of predominance and superiority, prompting the federal court to certify the two Classes.

Class certification is important in these cases because this allows the class action lawsuit to move forward to pre-trial procedures. The closer a class action moves to trial, the more likely it is that they will be able to collect compensation for Class Members.

Countrywide and LandSafe deny any wrongdoings detailed in the class action lawsuit. They contend that their mortgage loan appraisals were completely legal and in compliance with USPAP and other regulations.

      Why do you think this site can add you to the case? Did you not read?

      Also the case was close nine months ago. Even those who received expired, or bad checks, cannot request a new check after March 14, 2021.

      You are not a class member if you did not get an appraisal with Landsafe. Most parties who had loans with Countrywide did not. I did not, but for some reason my name was on the list.

    We also had a Home loan with said company, and I also know Bank of America is a very crooked Bank, I used them in years passed..any how this has been going on long enough someone get the big boy pants on and settle this been long enough……

    I purchased my VERY FIRST home in 2003.
    I had a loan with Countrywide in 2003, it was sold to Bank of America.
    From 2008 to 2019 Bank of America lied to me. Lie on top of lie on top of lie. They caused me to lose my home in 2019.
    My home meant everything to me. I waited 12 years to own my very own home. Not only did Bank of America cause me to lose my home, but they caused me to lose my quality of life from 2008 through the present, they caused me ALL OF THESE FOLLOWING SYMPTOMS I’VE NEVER EVER HAD BEFORE BANK OF AMERICA ENTERED MY LIFE AND TORE IT TO SHREDS!
    THE SYMPTOMS ARE:
    •mental stress
    •mental anguish
    •frequent panic attacks
    •anxiety
    •depression
    •social anxiety
    •loss of confidence
    •loss of trust of anyone and everything
    •several mental break downs •clenching my jaw, grinding
    my teeth to the point that all of my front and lower teeth are loose and it caused my upper and lower teeth to flare out and the alignment is all shifted. Which Bank of America will then cause me a BIG DENTAL BILL!
    •continuing repetitious nightmares
    •PTSD
    •social withdrawal
    •isolation
    •paranoia
    •worrying
    •disconnecting from family friends
    •which caused the loss of ALL of My Friends.
    •hating my life
    •continually seeing a therapist, EVERY SINGLE SESSION ALL I TALK ABOUT IS THE ANGER I HAVE FOR BANK OF AMERICA! AND HOW MUCH I JUST WANT TO GO BACK TO MY HOME! HOW MUCH I HATE LIVING IN AN APARTMENT!
    AND HOW IT MAKES ABSOLUTELY NO SENSE TO ME THAT I QUALIFIED FOR PART OF THE SETTLEMENT FOR THE “NATIONWIDE MORTGAGE SETTLEMENT” AND THEY STILL WERE ALOUD TO TAKE MY HOME EVEN AFTER THE LAWSUIT.
    HOW WERE THEY STILL ALOUD TO TAKE MY HOME??!! THAT IS WHERE THIS WHOLE LAWSUIT STARTED, THEM WANTING PEOPLES HOMES!
    I CAN’T WRAP MY HEAD AROUND IT!
    • I also see a psychiatrist for medication’s prescribed to me: It’s personal but to get a good understanding of what Bank of America did to my mental health this is what I have had to take:
    -2 different antidepressants
    -anxiety medication
    -a sleeping pill, and it too also helps with depression
    -high blood pressure medication

    • They caused my little boy who was 8 years old in 2008 when Bank of America flipped our lives upside down all they way thru 2019 when he was 19 years old. All of those precious years for him not be given a good quality of life!
    His room had nothing on the walls, due to the repetitive sheriff sales Bank of America scheduled and rescheduled. We HAD TO live out of boxes from 2008-2019!
    My son also lost his quality of life due to Mom, ME spending every moment fighting to keep our Special Home that was EVERYTHING TO US!
    Fighting for our home in every which way and avenue I could think of EVERY SINGLE DAY! It became a FULL TIME JOB!
    I wasn’t able to spend quality time with my son:
    • making various phone calls,
    • going to appointments with different attorneys, finding an attorney I felt confident in.
    • Then going to several appointments with the attorney I hired.
    • Several appointments with Green Path assisting their help making several phone calls to Bank of America and writing letters to Congress Woman Gwen Moore.
    • I also contacted the Department of Justice
    • HUD
    • Going to court dates.
    • EVERY SINGLE DAY FROM 2008-2019 I called Bank of America. EVERY SINGLE PHONE CALL lasted
    1-2 hours, that includes:
    – the hold time
    – the disconnection and recalling and holding AGAIN time.
    ALL OF THEM TOOK AWAY PRECIOUS TIME FROM MY SON EVERY SINGLE DAY FROM 2008-2019!!!!! FROM THE TIME MY SON WAS 8 YEARS OLD ALL THE WAY THROUGH UNTIL HE WAS 19 YEARS OLD!!! I WILL, WE WILL NEVER EVER GET ALL OF THOSE YEARS BACK! THEY TOOK AWAY OUR LIVES , OUR QUALITY OF LIFE, LIVING OUR LIVES TO THE FULLEST, ENJOYING LIFE, CREATING MEMORIES, HAVING FUN!
    I HAVE FROM 2019 AND WILL CONTINUE SEEKING JUSTICE A CLASS ACTION LAWSUIT OR AN ATTORNEY TO SUE BANK OF AMERICA FOR ALL OF THE MENTAL ANGUISH THEY CAUSED AND FOR TAKING AWAY MINE AND MY SONS QUALITY OF LIFE!!!!!!!!!!!!!!!!!!

    Basically I received A BIG SLAP IN THE FACE!!!!!!!
    After everything they put me through, my mental health stealing our quality of life, fighting and working hard all those hours, days, months, years! FOR 11 YEARS!
    I END UP WITH $803.00 and some change !!!!!! AND LOST OUR HOME! AND LEFT CONSTANTLY ASKING HOW THE HELL DO THEY STILL GET MY HOME AFTER THIS LAWSUIT, STATING “THEY LIED TO HOMEOWNERS ALL TO GET THEM TO GO INTO FORECLOSURE SO THEY COULD TAKE PEOPLES HOUSES!”

    BUT THEY STILL CAN TAKE ALL OF OUR HOMES!

    HOW THE HELL DOES THIS MAKE SENSE!!!
    IT DOESN’T!!!

    THE RIGHT THING TO DO WOULD HAVE BEEN:

    • PUT EVERY SINGLE HOME OWNER’S LOAN BACK TO WHERE IT WAS BEFORE BANK OF AMERICA SCREWED WITH IT!
    • AND THEY EAT ALL OF THE INTEREST AND ARREARS
    • AND EVERY SINGLE HOME OWNER STAYS IN THEIR HOME!!

    I NEED TO KNOW HOW AND WHY THEY STILL GOT TO TAKE ALL OF OUR HOMES!

    FOR ME TO GET CLOSURE.
    I HAVE BEEN TRYING TO FIGURE OUT WHO WOULD BE THE RIGHT PERSON FOR ME TO CONTACT, SO THEY CAN EXPLAIN TO ME WHY THEY WERE ABLE TO STILL TAKE MY HOME.
    THIS QUESTION HAS BEEN HANGING HEAVILY ON MY MIND SINCE THIS SETTLEMENT.

      Diane,
      I am so sorry for all your suffering directly caused by BOA and Countrywide. I am still in my home purchased May of 2001 and also different property May of 2003, but there is a discrepancy of 2 plus years of payments not credited to our account …payments I made but somehow my mortgage does not reflect it. BOA blames Countrywide for not applying payments or questioned us as to whether we missed payments which we never did contrary as I think I made a few extra as well,yet do you honestly think they would let us live here if we missed that many payments let alone one!! I often wonder if I had two loans that the person confused my primary home loan was confused (by an incompetent bank worker) with the date of the 2003 loan. Yet it is on me to prove I made over21 years of payments!!!
      I keep hoping to turn over the bit of evidence I need to prove them wrong!!
      Again I am so sorry for you losing your home and the pain you and your son have suffered from it.

      Diane, All of those things happened to me as well. I even spent my last dime to sue B of A not knowing that the courts were ignorant as to the mortgage/securitization process. The judges went with those that were closer to their pay grade. I was homeless for almost 5 years, living out of my car. You are still angry and I am still angry too. Stole all of my equity gained over 26 years. I was/am disabled and NO ONE CARED.. I finally had to realize that still no one cares.
