ARRIS SURFboard Cable Modem Class Action Website Established

A website has been set up for Class Members to learn about their rights in a class action lawsuit that alleges cable modems made by ARRIS International are defective.

Class Members include those who purchased an ARRIS SURFboard SB6190 cable modem in California on or after Oct. 1, 2015.

Whether the allegations against ARRIS are true or false has not yet been determined by the Court.

Lead plaintiffs accused the technology maker of selling the defective modem – the ARRIS SURFboard SB6190.

According to the class action lawsuit, a defective Intel Puma 6 chip was used in the manufacture of the internet network device.

According to the ARRIS SURFboard cable modem class action lawsuit, “A cable modem is a device that enables a computer to transmit data over a coaxial cable line. The modem is located at the cable subscriber’s home and connects to the cable network to receive and transmit digital information between subscriber-owned devices (such as desktop PCs or routers) and the service provider’s head end or central office, providing Internet connectivity for data and/or voice services.”

The speed of a cable modem is generally measured by the number of “bits per minute” or bpms. The larger the bpm, the faster the internet connectivity.

Plaintiff Carlos Reyna alleged that he purchased an ARRIS SURFboard cable modem in 2016. He says that he suffered unreliable internet connections, slow downs and interruptions while using his new modem.

The defective chip causes problems with network latency, leading to delays in communications over the network and much frustration for Class Members.

The plaintiffs contend that the ARRIS SURFboard cable modem is not fit for sale and the manufacturer falsely advertises the product. Specifically, the manufacturer deceptively touted the speed and reliability of the modem, alleges the ARRIS class action lawsuit.

ARRIS allegedly advertises that the modem is capable of up to 1.4 Gbps; however, the actual speed is much lower, according to the ARRIS cable modem class action lawsuit.

The Court has certified a Class of those who purchased the ARRIS SURFboard SB6190 cable modem in California on or after Oct. 1, 2015, along with a subclass of those who purchased the modem for household or personal use during the same timeframe.

The ARRIS SURFboard SB6190 cable modem class action lawsuit is seeking damages, restitution, and a court order requiring ARRIS to change its advertising practices.

In August 2018, the Court granted Class certification, in part. It also denied ARRIS’ attempts to exclude two of the plaintiffs’ witnesses.
