Vizio agreed to a $3 million class action lawsuit settlement to resolve claims that it inflated its TV refresh rate in advertisements to make its products look more attractive to consumers.

The settlement benefits consumers who purchased a Vizio television in California that was advertised as having a “120Hz Effective Refresh Rate” or “240Hz Effective Refresh Rate” between April 30, 2014, and June 20, 2024.

Plaintiffs in the class action lawsuit claim that Vizio falsely represented its TVs as having a higher refresh rate than they actually do. This false advertising allegedly deceived consumers into thinking that the TVs had better picture quality and were therefore worth more money. 

Vizio is a TV and entertainment company that sells its products at major retailers such as Best Buy, Walmart and Target.

Vizio hasn’t admitted wrongdoing but agreed to a $3 million settlement to resolve the false advertising class action lawsuit.

Under the terms of the settlement, class members can receive up to $50 for each television they claim. These payments may be decreased on a pro rata basis depending on the number of valid claims filed in the settlement.

In addition to cash payments, class members can benefit from an enhanced service and warranty package valued at $25. This benefit includes a customer support line and a limited one-year warranty to repair picture quality issues.

Vizio also agreed to change its labeling practices going forward to refrain from representing TVs as having inflated refresh rates.

The deadline for exclusion and objection is Feb. 29, 2024.

The final approval hearing for the Vizio TV refresh rate class action lawsuit settlement is scheduled for June 20, 2024.

In order to receive a settlement payment, class members must submit a valid claim form by March 30, 2024.

Receipts (including consumer name, TV model number, purchase date, retailer and, if an online purchase, the consumer’s state of residence), TV serial numbers, picture of the TV’s identifying information or a statement under penalty of perjury that the class member sold, donated, recycled or gave the TV away, with a statement that includes the TV model number, approximate date and location of purchase and approximate date of disposal or sale.

      Purchased 65” Black Friday of 2022 went out September of 2023 No help from Walmart and called Vizio and still no help so trashed it. Junk product
