Uber Eats agreed to pay $3.35 million as part of a class action lawsuit settlement to resolve claims that it violated the rights of prospective drivers in New York City through a flawed criminal background check process.
The settlement benefits consumers who were denied access to Uber Eats as a delivery person in New York City between Oct. 24, 2015, and July 28, 2021, based on the results of a criminal background check.
The settlement class is split into two groups. Group 1 class members are individuals with serious convictions that are more likely to be job-related based on the nature and recency of their convictions. Group 2 class members are individuals with convictions less likely to be deemed job-related.
Plaintiffs in the class action lawsuit claim Uber Eats used a flawed criminal background check process that unfairly denied individuals access to the platform as delivery drivers due to their criminal records. In addition to being unfair, this process allegedly failed to provide the legally required disclosures.
Uber Eats is a food-delivery and takeout platform connected to the Uber ridesharing app.
Uber Eats hasn’t admitted any wrongdoing but agreed to a $3.35 million settlement to resolve the background check class action lawsuit.
Under the terms of the Uber Eats settlement, class members can receive payment based on their class group membership.
Group 1 class members are entitled to a single payment of up to $70.
Group 2 class members will receive a pro rata share of the net settlement fund, which could result in significantly higher payments. Class members who received a mailed settlement notice also received a payment estimate.
Also as part of the settlement, Uber agreed to hire a consultant to review its current background-check policies and provide improvement recommendations. The company will consider and potentially accept these recommendations in addition to making its own changes.
The deadline for exclusion and objection is Dec. 29, 2023.
The final approval hearing for the settlement is scheduled for Feb. 8, 2024.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.

Who can I contact if this same thing happened in a different state?
The consultant they have hired to review their background check information etc of course is probably paid off or being done by a company or somebody that they know who will check everything off and sign off on everything like it’s perfectly fine. Lastly, at least we know that this is just another thing let’s added to why it is Uber is taking away more and more money from drivers. They feel that they have to make the money up somehow from the class action lawsuit so they take away money from drivers so that they can pay out the money. So for the people that are still driving don’t think that you’re getting paid anything back. Because they’re taking it out of your pockets by reducing pay. Which means you’re just getting money that you would have been making anyways prior to them reducing pay again and again and again
I will not say that I was the best teenager 10 years ago but I don’t believe that I should be judged and discriminated against as far as jobs in my life today. I have, for years, been clean and sober and I’m still being affected and I believe I have overcome a challenge that most people in the world cannot, or will not Uber eats was one of the many that judge me and shot me down and this is why I appreciate this against them.
I feel for you and it’s crazy because I just applied for Uber eats. And I was denied to work as a delivery driver with Uber eats. And this is this August 9, 2023. So clearly nothing has changed

I was arrested and I wasn’t charged. This was back in 1999 and because a mistake in court the case stayed pending until 2016. When I went to court the case got straighten out without any conviction. And because of that the background company denied me a chance to work for Uber. Now when should I expect my compensation. I am in group two because I got a letter saying that I was getting double the amount from the original class action settlement. I just want to know when I should I expect it in the mail.
Yes I applied for many of the Rideshare and doordash and Uber Eats and I was denied by every single one of them because of my background they didn’t even give me a chance to explain that I spent time in prison for something I didn’t even do and it happened over 7 years ago and they just didn’t even give me a chance I had even wrote them an email explaining all of this and no response nothing.
Same here in Florida and I have the emails stating why they wouldn’t hire me

Uber eats conducted a second background check on me after I had been working for them for over a year. The second one caused me to lose that gig. I feel like they did this because a few days before I called them out for not paying me for completed work. The only problem is I live in Oregon. I would like them to be held accountable in Oregon as well. Is there anything I can do?
Please add me I lost everything I worked for Uber 2 years and and dropped with no notice or cause.
