First American Payment Systems paid $4.9 million in a lawsuit settlement with the Federal Trade Commission to resolve claims it charged illegal early termination fees.
The settlement benefits business owners who were charged an early termination fee after canceling their enrollment with First American Payment Systems. The FTC has identified 1,137 business owners as eligible for refunds.
According to the FTC, First American Payment Systems used misleading sales tactics and charged business owners early termination fees when they canceled their enrollment. The payment processor used several sales offices, including Eliot Management Group, Cypress Bay Solutions, Sundance Payment Solutions, Billy Goat LLC, Chelle Communications, Appstar Financial, Payscape Advisors and Blue Dog Business Services.
First American Payment Systems is a payment processing company that offers in-store, online and mobile payment solutions.
Under a federal court order, First American paid $4.9 million for its allegedly deceptive business practices that harmed small business owners.
Under the terms of the settlement, business owners will receive a refund based on the amount they paid in early termination fees. No refund estimates are available.
There is no exclusion or objection deadline for this settlement.
To receive a refund, business owners must submit a valid claim form by May 28, 2024.
