Rizzetta & Co. agreed to a class action lawsuit settlement to resolve claims that it charged illegal HOE fees that violated Florida’s statutory cap.
The settlement benefits owner-sellers of properties in Rizzetta-managed communities who requested and received an estoppel certificate from Rizzetta and paid fees related to this request between Feb. 17, 2019, and Sept. 20, 2023, where the total fees (estoppel certificate fees, third-party convenience fees and third-party service charges together) exceeded the applicable statutory cap.
According to the class action lawsuit, Rizzetta & Co. charged fees that exceeded the statutory cap allowed under Florida’s Deceptive and Unfair Trade Practices Act. The HOA company allegedly charged these fees when owner-sellers requested estoppel certificates for their properties.
Rizzetta & Co. is a community management company based in Florida.
Rizzetta & Co. hasn’t admitted to wrongdoing but has agreed to pay an undisclosed sum to resolve the class action lawsuit.
Under the settlement terms, class members can receive $16 for each estoppel certificate fee they incurred during the class period.
The deadline for exclusion is April 20, 2024. The objection deadline for the settlement is April 10, 2024.
The final approval hearing for the settlement is scheduled for April 30, 2024.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive their refund payment to their most recent address on file. Class members can update their mailing addresses on the settlement website.
