Infinity Healthcare fees $2M class action settlement

Infinity Healthcare agreed to a $2 million settlement to resolve claims it charged illegal record retrieval and certification fees.

The settlement benefits Infinity Healthcare patients in Wisconsin who requested their health care records and were charged a base, basic, retrieval, certification or other fee of over $1 per page since April 18, 2013.

According to the class action lawsuit, Infinity Healthcare violated Wisconsin law by charging excessive fees to retrieve and certify patient health records. Plaintiffs in the case argue they sustained financial damage by these basic, retrieval, processing and certification fees.

Infinity Healthcare is a health system headquartered in Milwaukee.

The health system hasn’t admitted wrongdoing but agreed to a $2 million settlement to resolve the class action lawsuit.

Under the settlement terms, class members can receive up to four times the amount they paid in any basic, retrieval, processing and/or certification fees. Payment amounts will vary depending on the amount each class member paid to Infinity Healthcare. Class member payments will be proportionately reduced if the total amount claimed exceeds the settlement fund.

The deadline for exclusion and objection is April 26, 2024.

The final approval hearing for the settlement is scheduled for May 23, 2024.

To receive a settlement payment, class members must submit a valid claim form by April 26, 2024.
