Personal Touch Holding Corp. agreed to a class action lawsuit settlement to resolve claims it failed to protect patient information from a 2021 data breach; class members must submit a claim form to benefit.

The settlement benefits individuals who received a data breach notification from Personal Touch Holding Corp. around March 24, 2021, informing them their personal information and protected health data may have been compromised in a January 2021 data breach.

According to the class action lawsuit, hackers accessed sensitive personal information and protected health data, including Social Security numbers, stored on Personal Touch’s databases in January 2021. Plaintiffs in the case claim Personal Touch could have prevented the data breach by implementing reasonable cybersecurity measures but negligently failed to do so.

Personal Touch is a home care company that helps provide home care for patients in New York, Indiana, Kentucky, Virginia and West Virginia.

Personal Touch hasn’t admitted wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Personal Touch data settlement, class members who submit a valid claim form can receive up to $125 for out-of-pocket data breach-related expenses if their information was not compromised in the data breach. This reimbursement is for expenses such as mileage, communication charges and other miscellaneous expenses. It also covers credit monitoring or other mitigative costs incurred on or after Jan. 20, 2021, or the earliest verifiable date of the class member’s receipt of the data breach notice through the date of their claim submission.

Class members whose personal information was compromised by the data breach can receive larger reimbursement payments of up to $7,500. These payments will reimburse class members for damages related to identity theft or fraud in addition to other miscellaneous expenses, such as the cost of credit monitoring, bank fees and up to three hours of lost time compensated at a rate of $25 per hour.

The deadline for exclusion and objection is May 21, 2024.

The final approval hearing for the Personal Touch Holding Corp. class action lawsuit settlement is scheduled for July 22, 2024.

To receive benefits, Personal Touch data settlement class members must submit a valid claim form by May 21, 2024.
