New York City agreed to pay $2.45 million to resolve a class action lawsuit claiming it enforced parking summonses that wrongfully identified tractors as non-tractor vehicles.
The settlement benefits registered owners or lessors of tractors who received a parking summons from New York City between Jan. 1, 2014, and May 2, 2022, that wrongfully describes the vehicle body type as something other than a tractor. Owners and lessors are not eligible for the settlement if their tractors are enrolled in a reduced-fine program.Â
Plaintiffs in the parking class action lawsuit claim New York City violated vehicle and traffic laws by wrongfully identifying tractors as non-tractors in parking summonses. This conduct allegedly caused vehicle owners and lessors to overpay for parking penalties.Â
New York City has unique parking regulations that govern how and where vehicles, including tractors, can park.Â
New York City hasn’t admitted any wrongdoing but agreed to a $2.45 million settlement to resolve the tractor parking dispute.
Under the terms of the settlement, class members can receive a refund based on the administrative remedies they pursued:Â
- Individuals who pursued all administrative remedies can receive a 100% refund of the amount they paid.Â
- Those who sought partial administrative remedies can receive up to 30% of the amount they paid.Â
- Claimants who did not pursue administrative remedies can receive up to 20% of the amount paid.Â
- Individuals who did not pay anything or only paid part of their penalties can have their remaining balance reduced.Â
The deadline for exclusion and objection is July 19, 2023.
The final approval hearing for the settlement is scheduled for Aug. 23, 2023.
In order to receive a settlement payment, class members must submit a valid claim form by Aug. 9, 2023.
