An MRO Corp., Ciox Health LLC and Medi-Copy Services Inc. settlement provides payments to West Virginia patients, attorneys and insurance companies who paid excessive fees to retrieve medical records.
The settlement benefits patients, insurance companies and attorneys who submitted a release of information request for copies of medical records from West Virginia medical providers and paid fees for these records between Dec. 1, 2010, and July 5, 2017.
Subclass 1 includes patients, insurance companies and attorneys who submitted medical records requests between Dec. 1, 2010, and June 5, 2014, and paid a per-page fee to obtain copies.
Subclass 2 includes patients who submitted medical records requests between June 6, 2014, and July 5, 2017, and paid a per-page fee to obtain copies.
Subclass 3 includes insurance companies and attorneys who submitted medical records requests between June 6, 2014, and July 5, 2017, and paid a per-page fee to obtain copies.
Subclass 4 includes patients, insurance companies and attorneys who submitted medical records requests between June 6, 2014, and July 5, 2017, and paid a retrieval fee to obtain copies.
Plaintiffs in the class action lawsuit claim MRO, Ciox and Medi-Copy charged excessive fees for copies of medical records from West Virginia providers. According to the class action lawsuit, these fees violated West Virginia law.
MRO Corp., Ciox Health LLC (now known as Datavant) and Medi-Copy Services Inc. are medical records companies that partner with medical providers around the country.
MRO, Ciox and Medi-Copy haven’t admitted any wrongdoing but agreed to a settlement to resolve the medical record fee class action lawsuit.
Under the terms of the settlement, Class members can receive a cash payment based on the amount they paid for medical records and their class membership.
Members of subclasses 1, 2, and 3 can receive payments based on the amount they paid per page for medical records. Subclass 1 class members can receive the difference between the per-page fee paid and the negotiated fee of $0.50 per page. Subclass 2 class members can receive the difference between the per-page fee paid and the negotiated fee of $0.12 per page. Subclass 3 class members can receive the difference between the per-page fee paid and the negotiated fee of $0.28 per page. Subclass 4 class members can receive full reimbursement for the medical records fees they paid for medical records during the class period.
The deadline for exclusion and objection is June 18, 2024.The final approval hearing for the settlement is scheduled for July 11, 2024.Â
To receive settlement benefits, class members must submit a valid claim form by June 28, 2024.
