belVita Biscuits, Bites, and Sandwiches Added Sugar $8M Class Action Settlement

Mondelēz will pay $8 million as part of a belVita class action settlement resolving claims the product’s marketing deceives consumers.

The settlement benefits consumers in the United States who purchased belVita Crunchy Biscuits, belVita Soft Baked Biscuits, belVita Bites, and belVita Sandwiches in various flavors between Nov. 16, 2013, and Nov. 17, 2021.

Plaintiffs in the belVita class action lawsuit claim that Mondelēz International Inc. violated consumer protection laws with false labeling. belVita packaging claims allegedly mislead consumers into believing that the products are healthy despite high levels of added sugar. The plaintiffs say they were deceived into paying a higher price for belVita products based on these marketing claims.

Mondelēz agreed to pay $8 million to resolve the claims surrounding its belVita products. The deal provides injunctive relief in the form of updated package claims which exclude the words “nutritious,” “healthy,” “balanced,” or “wholesome.” The belVita settlement also provides monetary relief in the form of cash payments.

Under the settlement, eligible Class Members can recover cash payments estimated to be $34.10. Exact payments will vary depending on the net settlement fund after cost and fees deductions. Payments will be proportional to the number and cost of products purchased by Class Members.

To receive a higher payment, Class Members must provide proof of purchase. Without a receipt or other form of proof, consumers can only claim 2 products per month of belVita purchases. Claims that include proof of purchase are not subjected to these limitations.

A final approval hearing will take place April 4, 2022.

Class Members have until Feb. 9, 2022, to exclude themselves from or object to the belVita settlement.

belVita purchasers must file a valid claim form by Feb. 9, 2022 in order to benefit from the settlement.

Who’s Eligible

Consumers who purchased belVita Crunchy Biscuits, belVita Soft Baked Biscuits, belVita Bites, and belVita Sandwiches in various flavors between Nov. 16, 2013, and Nov. 17, 2021.

Specifically, the following products are included in the settlement:

• belVita Crunchy Biscuits (Toasted Coconut, Cranberry Orange, Golden Oat, Blueberry, Cinnamon Brown Sugar, Chocolate, Apple Cinnamon, Pumpkin Spice)
• belVita Soft Baked Biscuits (Banana Bread, Cinnamon, Mixed Berry, Oats & Chocolate, Oats & Peanut Butter)
• belVita Bites (Chocolate, Mixed Berry, Cinnamon Brown Sugar)
• belVita Sandwiches (Peanut Butter, Vanilla Yogurt Crème, Strawberry Yogurt Crème, Dark Chocolate Crème)

Varies, estimated to be $34.10

Exact payments will vary depending on the number of claims filed and the amount deducted in costs and fees. Consumer payments will be proportional to the number and cost of products purchased during the Class period.
