Medical Healthcare Solutions agreed to a class action lawsuit settlement to resolve claims that it failed to prevent a 2021 data breach that compromised patient information.
The settlement benefits individuals whose personal information was accessed in the Medical Healthcare Solutions data breach and/or who received a data breach notification from Medical Healthcare Solutions about a cyberattack that occurred between Oct. 1 and 4, 2021.
Plaintiffs in the class action lawsuit claim Medical Healthcare Solutions could have implemented reasonable cybersecurity measures to prevent a 2021 data breach. The breach reportedly compromised sensitive patient information such as ID numbers, Social Security numbers, payment card information and more.
Medical Healthcare Solutions is a medical coding and billing company that partners with healthcare providers to bill patients and their insurance companies.Â
The company hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum as part of a settlement to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $150 in reimbursement for documented ordinary expenses such as bank fees, communication charges, credit costs and up to three hours of lost time at a rate of $25 per hour. Class members can also receive up to $5,000 for extraordinary data-breach losses, such as monetary damages arising from fraud or identity theft.Â
Claimants can also receive two years of free credit monitoring and identity theft protections from Equifax Complete Premier. This service includes real-time, three-bureau monitoring, fraud resolution services and $1 million in identity theft insurance.
Class members who do not wish to claim any documented data breach expenses or receive credit-monitoring benefits can instead choose to receive a one-time payment of $50. These payments may be increased or decreased on a pro rata basis, depending on the number of claims filed. No proof of loss is required to receive these payments.
The deadline for objection was Jan. 5, 2024.
The final approval hearing for the settlement is scheduled for Feb. 8, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by Feb. 5, 2024.
Who’s Eligible
Individuals whose personal information was accessed in the Medical Healthcare Solutions data breach and/or who received a data breach notification from Medical Healthcare Solutions about a cyberattack that occurred between Oct. 1 and 4, 2021.

$5,150 OR $50
Proof of Purchase
Account statements, receipts for credit monitoring, order confirmations, identity theft reports, fraudulent credit entries and other documentation of data breach-related expenses are required for reimbursement payments.
No proof of loss is required to receive a one-time cash payment.
