Med-Call Healthcare agreed to pay $350,000 to resolve a class action lawsuit claiming it violated federal and state labor laws by failing to include on-call and travel times in overtime calculations. 

The settlement benefits Med-Call nurses, nursing assistants and other personnel working for Med-Call Healthcare in Florida from Jan. 31, 2019, to Jan. 31, 2022.

Plaintiffs in the class action lawsuit accuse Med-Call Healthcare of failing to include compensable on-call time, travel time and hourly stipends when calculating the overtime rate for its nursing staff at vaccination sites. This allegedly caused nurses to be underpaid for their overtime hours.

Med-Call is a healthcare staffing agency based in Illinois.

Med-Call hasn’t admitted any wrongdoing but agreed to a $350,000 settlement to resolve the overtime class action lawsuit.

Under the terms of the settlement, class members can receive a proportional share of the net settlement fund based on the number of pay periods and hours they worked during the class period. 

No payment estimates are available at this time. 

The deadline for exclusion and objection is Oct. 2, 2023.

The final approval hearing for the settlement is scheduled for Oct. 11, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits. Class members can update their address on the settlement website to ensure their payment is sent to the correct place.
