Meta agreed to a $68.5 million class action lawsuit settlement to resolve claims that Instagram violated Illinois’ Biometric Information Privacy Act (BIPA).
The settlement benefits individuals who used Instagram while in Illinois between Aug. 10, 2015, and Aug. 16, 2023.
According to the class action lawsuit, Instagram violated Illinois users’ biometric privacy rights by collecting and storing biometric information without using the proper disclosures and consent agreements. This allegedly violated BIPA.
Instagram is a Meta app that involves pictures and videos that may involve technology that tracks users’ biometric information.
Meta hasn’t admitted any wrongdoing but agreed to a $68.5 million settlement to resolve the BIPA class action lawsuit.
Under the terms of the Instagram settlement, class members can receive an equal share of the net settlement fund. Payment amounts will vary depending on the number of valid claims filed.
No payment estimates are available at this time.
The deadline for exclusion and objection is Aug. 16, 2023.
The final approval hearing for the Instagram BIPA settlement is scheduled for Oct. 11, 2023.
In order to receive an Instagram settlement payment, class members must submit a valid claim form by Sept. 27, 2023.

what if I was only visiting Illinois in this time frame?
I opened an Instagram account during this time frame so I could see things others have posted, but have not posted anything, myself. I don’t know if that qualifies me or not.
It would be sufficient having the account opened is plenty.
Please include me in this class action. I used Instagram occasionally during the timeframe stated. Thank you. LL
