A Travelers property damage class action settlement has been reached to resolve claims that the insurance company mislead consumers about rot insurance.

The settlement benefits individuals who made a Travelers property damage claim (including rot damage) under a policy which included rot remediation coverage but was partially or fully denied by Travelers.

Plaintiffs in the Travelers property damage class action lawsuit claim that consumers are taken advantage of by the insurance company. Allegedly, Travelers sells policies to consumers, but fails to disclose that their coverage is associated with extreme terms.

Sean and Jamie Rose reportedly purchased Travelers property damage coverage which included additional rot damage, fungus and microbes coverage. When their pipe broke in their home in August 2018, the couple says they believed the damage would be covered by their insurance. However, they were allegedly told that it would not be covered because the broken pipe could have been leaking for a long period of time.

“Rot is indicative of an ongoing presence of moisture for weeks, months and years. Since water damages that occur for a period of weeks, months or years are excluded, your policy does not provide coverage,” Travelers allegedly said in a letter to the couple.

The Travelers property damage class action lawsuit claims that the Rose couple and other consumers were deceived by the insurance company. According to the plaintiffs, Travelers knew that they would not provide the coverage promised to consumers but still advertised the coverage in order to make more money.

“The practice of Travelers in interpreting the portion of the policy, advertised as ‘additional coverages,’ despite the intention to never provide this additional coverage which is otherwise provided in this policy and was provided in previous policies, has been perpetrated by Travelers maliciously and in conscious disregard for the rights of its policyholders solely for the financial advantage of Travelers,” the Travelers property damage class action lawsuit argues.

Under the Travelers property damage class action settlement, Class Members can collect up to $3,750. Payments to consumers will depend on whether or not their claims were made during a valid policy period and the amount of claimed rot damage. Further information about distribution is available in the “Potential Award” section below.

In order to benefit from the settlement, Class Members must file a valid claim form by May 28, 2020. For higher payment amounts, Class Members must include documentation such as a cancelled check or other evidence of payment to a contractor for repair of rot damage; a rot damage repair estimate; bill(s) or invoice(s) from a contractor; or photograph(s) of un-repaired rot damage being claimed.

The deadline for exclusion and objection is May 13, 2020. The final approval hearing for the Travelers property damage class action settlement is June 23, 2020.

Who’s Eligible

Individuals who made a Travelers property damage claim (including rot damage) under a policy which included rot remediation coverage but was partially or fully denied by Travelers.

Potential Award

Up to $3,750.

Payments will depend on the amount of rot damage claimed by consumers, based on actual or estimated repair costs, regardless of whether or not work was completed. For valid policy period claims, the following distribution will apply:

For valid statutory period claims, Class Members can collect a flat payment of $150.

Proof of Purchase

Cancelled check or other evidence of payment to a contractor for repair of rot damage; a rot damage repair estimate; bill(s) or invoice(s) from a contractor; or photograph(s) of unrepaired rot damage being claimed.
