Facebook users may be able to benefit from a $650 million class action settlement fund resolving Illinois Biometric Information Privacy Act (BIPA) violation claims. Individuals who file a valid claim may be able to recover cash payments of between $200 and $400.
The settlement deal benefits Facebook users in Illinois for whom Facebook created and stored a “face template” since June 7, 2011. Eligible users must have lived in Illinois for at least six months.
Facebook users argued that the social media giant had unlawfully stored their valuable biometric data through “face templates.” These profiles allegedly helped users tag photos with suggested matches – but the Facebook privacy class action lawsuit said that the service hinged on unlawful actions.
According to the Facebook users, these face templates violated BIPA.
BIPA aims to protect Illinois residents from fraud in connection with their face scans, fingerprint scans and other biometrics. The law includes several requirements businesses must follow when collecting, storing or sharing this data.
After more than five years of litigation, Facebook has agreed to resolve users’ claims with a $650 million privacy settlement. The deal does not assign any wrongdoing to Facebook but allows all parties in the case to resolve the claims without the risk or cost of a trial.
The original terms of the settlement would have provided $550 million in benefits. However, this deal was later revised after U.S. District Judge James Donato questioned the true value of the deal.
“You are all fond of telling me this is a record-breaking settlement and that may be,” Judge Donato told attorneys for both parties. “But I want to see a record-breaking claims rate as well.”
After the deal was revised, Judge Donato signed off on the settlement terms.
Under the terms of the settlement, Facebook has agreed to turn off its facial recognition feature for most Class Members. These Facebook users have the ability to turn the service back on. However, if they choose not to, Facebook has agreed to delete all existing face templates for the users.
In addition to injunctive relief, the Facebook users privacy settlement will provide cash payments to consumers estimated to be between $200 and $400 per person. Exact payments will depend on the number of valid claims filed and the amount deducted from the settlement fund for fees, costs and other awards.
In order to benefit from the Facebook privacy settlement, Class Members must file a valid claim form by Nov. 23, 2020. An email address or telephone number associated with a Facebook user’s account is required to file a claim, but Facebook’s records will be used to verify claims.
The deadline for exclusion and objection is Nov. 23, 2020. The final approval hearing for the Facebook users’ privacy settlement is Jan. 7, 2021.

I have not received any check so I reached to the administrator because I’d since moved.. he put me on hold for 10 minutes when he returned he informed me to expect it between 8-10 weeks nothing…so I called a second time and this time she told me my name’s not on the list well I’m a subscriber to this sight and I’m certain I’ve filled the claim out

Never received 2nd payment through Zelle.
I filed for this, then told my husband & a few family members about this. They all received both checks. I’ve never received a penny. I tried contacting them in the time frame they asked us to, of this happened, & of course – NOTHING. At least send me an email with the picture of a middle finger – at least that would have been a response. I emailed at least 2 or 3 times regarding this (the phone number for it never worked . Always the same recording with no options, then it hangs up on you). Just wanted to say to the law team, “thank you” for your professionalism & ability to follow up. 🙄

I am receiving mail from the Facebook BIPA today. I already received my settlement check last year. I went to the website and there was an update saying:
The Settlement Administrator began sending supplemental settlement payments to class members who cashed their initial settlement payment on February 28, 2023.
Do that mean we are getting another check?
