Gas South has agreed to a proposed settlement to resolve a class action lawsuit that alleged the company failed to protect customers’ personally identifiable information (PII) during a data breach by hackers.

The class is made up of anyone whose PII was compromised as a result of the data breach and/or who was notified or should have been notified by or on behalf of Gas South that their data was compromised as a result of the breach.

Gas South is a natural gas provider based in Atlanta serving some 425,000 customers in Georgia and 13 other states. 

The data breach occurred in or around February 2022. The information accessed included names, Social Security numbers, birthdates and more. 

Under the settlement terms, class members who submit a valid claim form can receive two years of free single-bureau credit monitoring and identity theft protection, which includes dark web monitoring, $1 million in identity theft reimbursement insurance and identity recovery and restoration.

Class members with documented out-of-pocket losses can also receive up the $250 for bank fees, credit report fees, unreimbursed losses related to fraud of identity theft and other ordinary losses. This amount also includes lost time calculated at a rate of $20 per hour for up to four hours.  

Class members may claim up to $3,000 in extraordinary losses — actual, documented and unreimbursed monetary losses more than likely caused by the data breach. The loss must have occurred between Feb. 13, 2022, and Feb. 1, 2024, and must not already be covered by the ordinary loss category of claims. The class member also must have made reasonable efforts to avoid or seek reimbursement for the loss.

The cap on all payments ordinary and extraordinary loss claims is capped at $590,000. If the total of claims exceeds that cap, payments will be reduced on a pro rata basis.

The deadline to opt out of or object to the Gas South settlement has passed.

A final fairness hearing will take place Feb. 9, 2024.

The deadline to file a claim form is Feb. 1, 2024.

Anyone whose PII was compromised as a result of the data breach and/or who was notified or should have been notified by or on behalf of Gas South that their data was compromised as a result of the breach.
