Freedom Mortgage Fees Settlement

Nationwide consumers who received mortgages through Freedom Mortgage Corp. and paid money for fees on property inspections may be eligible for compensation in the form of a payment as a result of a recent class action lawsuit settlement.

Settlement Class Members include United States citizens who held mortgages through Freedom Mortgage Corp. and paid fees on property inspections after defaulting or being delinquent on their mortgage payments between March 5, 2013, and Dec. 31, 2020.

In the lawsuit documents, Plaintiffs allege that Freedom Mortgage Corporation charged fees to borrowers on mortgage loans unnecessarily and improperly.

The Company denies the allegations of the Plaintiffs and strongly contends that its actions were always lawful and proper. Both the Plaintiffs and Defendants have reviewed the terms of the Proposed Settlement Agreement and believe that it provides an adequate solution to the claims.

Freedom Mortgage Corp. is currently the third-largest lender in the United States. Across the nation, the company employs over 2,000 Americans and makes about $1.18 billion in revenue.

Class Members who submit a valid claim can receive a one-time payment equal to 35 percent of the amount of the first property inspection fee paid to Freedom Mortgage. Class Members will receive another payment of 50 percent of the amount of all inspection fees paid to Freedom Mortgage. The exact amount each individual Class Member will receive hinges on this formula’s calculations on a case-by-case basis and the total amount of claims made in this class action lawsuit.

Class Members who want to seek out individual lawsuits should exclude themselves from this current class action settlement. The deadline to file an exclusion is Dec. 16, 2021.  Class Members who exclude themselves from this class action lawsuit will not receive a payment.

Class Members who do not agree with the terms of the settlement but do not wish to exclude themselves must file an objection by the same date, Dec. 16, 2021.

Class Members who do not take action at all will not receive their share of the settlement fund. Despite that, they will still be bound by the terms of the proposed settlement agreement, which means that they will not be eligible to seek out future litigation regarding this matter.

A final approval hearing will take place Feb. 10, 2021.

The deadline to file a claim in this class action settlement is Dec. 16, 2021.

    They are still charging these ghost charges and when you pay late fee with monthly mortgage payment they put that late fee in a holding account until mortgage is caught up but until then they continue to tack on late fees and inspection fee which no one shows up. RIDICULOUS!

    I wish I would have seen this sooner. Freedom mortgage was my mortgage holder in Oct of 2006. I had mortgage insurance of nearly $200 per month added on at closing. In 2008 my income was cut by 1/3rd and I was unable to make my house payments. Around December of 2008 I contacted the mortgage servicer Loancare and they said they could help me get a loan modification. Once I fell behind on the payments, and I had missed three payments. So I missed three payments, and the only thing they did was begin foreclosure. The collection department didn’t know anything about the loan modification. This went on for months until I finally had to get a chapter 13 to keep my home. When I finally got a loan modification in 2011 or 12 they had set a side almost $40,000 with no payments to bring my loan to what my home was actually worth. My house was recently assessed at just $2,000 under my original purchase price. But I owe $6,000 over my original purchase price with the set a side balance.
