Evig was ordered to pay $1.1 million to the state of California to resolve claims that it deceptively advertised its Balance of Nature products, and no proof of purchase is required for consumers to benefit.

California consumers are eligible for compensation if they purchased a Balance of Nature Fruits, Veggies and/or Fiber & Spice supplement product within the last six years.

The lawsuit from several county attorneys general claimed that Evig’s Balance of Nature products were falsely advertised as containing the “nutritional equivalent of over 5 servings of fruits per dose.” Additionally, the supplements were allegedly marketed to consumers who had been diagnosed with serious diseases such as diabetes, arthritis, heart disease, fibromyalgia and cancer.

Evig’s Balance of Nature brand sells supplements that claim to provide the nutritional value of fruits and vegetables.

In a judgment order, the court ordered Evig to pay $850,000 in civil penalties and $250,000 in restitution.

Under the terms of the judgment, consumers who purchase Balance of Nature supplements can receive a cash payment. No payment estimates are available at this time. Consumers can receive a payment from the settlement even if they do not have proof of purchase.

There is no exclusion or objection deadline for the settlement.

The court’s judgment order was filed on June 23, 2023.

In order to receive benefits, consumers must submit a valid claim form by Nov. 3, 2023.
