Desert Financial Credit Union agreed to pay $4 million to resolve a class action lawsuit alleging it charged illegal overdraft fees.

The settlement benefits consumers who have or had a checking account with Desert Financial Credit Union and who were charged an unrefunded overdraft fee between June 1, 2014, and Nov. 1, 2017, on a transaction that was authorized with a sufficient balance but settled with an insufficient balance. 

The overdraft class action lawsuit claims Desert Financial Credit Union wrongfully charged overdraft fees on transactions that were authorized with a sufficient balance. These transactions were allegedly settled with an insufficient balance and resulted in overdraft fees.

Desert Financial Credit Union is a financial institution based in Arizona. 

Desert Financial hasn’t admitted any wrongdoing but agreed to a $6 million settlement to resolve the overdraft class action lawsuit.

Under the terms of the Desert Financial Credit Union overdraft fees settlement, class members can receive a proportional share of the net settlement fund based on the amount they paid in overdraft fees. 

No payment estimates are available at this time.

The deadline for exclusion is July 14, 2023. The deadline for objection is Aug. 18, 2023.

The final approval hearing for the settlement is scheduled for Aug. 18, 2023.

No claim form is required to benefit from the settlement. Class members who received a settlement notice will automatically receive a settlement payment if they do not opt out.
