Consumers who purchased items from Best Buy and were affected by a 2017 data breach may be eligible for compensation for out-of-pocket expenses and time spent dealing with the breach thanks to a recent class action lawsuit settlement.

Settlement Class Members include everyone who received a mailed or emailed notice about the 2017 Best Buy data incident. Class Members were affected by a 2017 cyberattack and either lost money, needed to replace financial cards, felt the need to pay for credit monitoring services, or spent time dealing with the results of the attack.

The plaintiffs allege their private financial information was obtained by hackers during a criminal cyberattack in the fall of 2017. 

In the Best Buy data breach class action lawsuit, the plaintiffs say they were shopping on the Best Buy website before realizing their information was stolen. Further, the plaintiffs say the company failed to provide adequate, timely, or even accurate information regarding the incident. As a result, some plaintiffs were unaware their information was at risk and potentially in the hands of hackers until their finances were affected.

Best Buy, which sells products such as electronics and appliances, has 1,037 stores throughout the United States, the District of Columbia, and Puerto Rico.

The company denies all allegations from the plaintiffs and denies any wrongdoing. 

The Court did not make any ruling of innocence or guilt in this case. Instead, both the plaintiffs and defendants have decided the proposed Best Buy lawsuit settlement agreement is in the best interests of everyone involved.

As a part of the Best Buy data breach settlement agreement, Class Members are eligible to receive reimbursement for both out-of-pocket expenses and time spent dealing with the effects of the data incident. 

Class Members who can provide documentation regarding unreimbursed bank fees, card re-issuance fees, overdraft fees, telephone charges, charges from banks or credit card companies, interest, credit report costs, or fraud resolution services costs can receive up to $2,000 in compensation. 

Class Members who can provide documentation regarding time spent dealing with the data incident can claim up to $20 per hour for up to three hours of lost time.

Class Members have a right to exclude themselves from this current settlement. Class Members who exclude themselves will retain the right to pursue future lawsuits, but they will not be eligible to receive compensation. 

Class Members can also file an objection if they disagree with the proposed settlement.

A final approval hearing is scheduled for Jan. 27, 2022.

The deadline to opt out of or object to the Best Buy lawsuit settlement is Nov. 22, 2021.

The deadline to file a claim in this class action settlement is Dec. 22, 2021.

Who’s Eligible

Potential Award

Up to $2,060.

Class Members who can provide documentation regarding unreimbursed bank fees, card re-issuance fees, overdraft fees, telephone charges, charges from banks or credit card companies, interest, credit report costs, or fraud resolution services costs can receive up to $2,000 in compensation. 

Class Members who can provide documentation regarding time spent dealing with the data incident can claim up to $20 per hour for up to three hours of lost time.

Receipts, bills, and other documentation regarding unreimbursed bank fees, card re-issuance fees, overdraft fees, telephone charges, charges from banks or credit card companies, interest, credit report costs, or fraud resolution services costs.

    I had to contact them about their data breach on or before June 16,2023 because an email alerted me to someone trying to access my account. Then I go online and see there was actually a data breach that the customer service said nothing about. I was told someone would be contacting me from their financial office soon. (I got the alert and use a different device to logon and change my password)
