A $2.5 million settlement has been reached to resolve claims that Mutual of Enumclaw Insurance Company underpaid total loss car accident settlements.
The settlement will benefit individuals in Washington who had a vehicle adjusted to be a total loss by Mutual of Enumclaw on an accident occurring between Sept. 1, 2011 and March 15, 2019.
Plaintiff Michael Steinore filed his class action lawsuit against Mutual of Enumclaw in September 2017, claiming that the company routinely underpaid total loss settlements based on faulty valuations from Audatex’s Autosource system.
According to the class action lawsuit, Enumclaw took deductions for “typical negotiation” that were not supported by facts nor were they reasonable. Steinore argued that these deductions were a violation of Mutual of Enumclaw’s insurance contracts and constituted unfair business practices.
Mutual of Enumclaw has denied any wrongdoing but has agreed to settle the class action lawsuit in order to resolve the claims without the risks and costs of continuing the fight in court through to a trial verdict.
The amount that each Class Member can recover will depend on the amount that Mutual of Enumclaw paid as a part of their total loss settlement. According to the settlement notice, a rough payment estimate can be determined by multiplying the amount Enumclaw paid by 3.5 percent.
In order to receive payment, Class Members need to file a valid claim by Sept. 9, 2019. The deadline for exclusion is June 28, 2019. The deadline for objection is July 25, 2019. The final approval hearing is scheduled for Aug. 9, 2019.
Who’s Eligible
Individuals insured by Mutual of Enumclaw under a Washington policy issued in Washington state who were paid for the total loss of their vehicle(s) under one of their Enumclaw First Party Coverages (comprehensive, collision, UIM) and received a total loss valuation from Enumclaw based on an Autosource estimate between Sept. 1, 2011 and March 15, 2019.
If Enumclaw did not take a “typical negotiation” discount from your total settlement payment, you may not be eligible for the settlement.
Potential Award
Varies depending on the original total loss payment received from Mutual of Enumclaw. A rough payment estimate can be determined by multiplying the amount Enumclaw paid by 3.5 percent.
