$2.99M Modernizing Medicine data breach class action settlement

Modernizing Medicine Inc. (ModMed) agreed to a $2.99 million class action settlement to resolve claims it failed to protect patient information from a 2025 data breach.

The Modernizing Medicine settlement benefits individuals who received a data breach notice from Modernizing Medicine informing them that their information was compromised in a July 2025 data breach.

According to the class action lawsuit, Modernizing Medicine failed to protect patient data from a 2025 data breach that allegedly compromised sensitive patient information, such as Social Security numbers, health insurance data and medical information.

Modernizing Medicine is a healthcare technology company that provides a cloud-based, specialty-specific electronic health records platform alongside revenue cycle management solutions.

ModMed has not admitted any wrongdoing but agreed to a $2.99 million class action settlement to resolve the Modernizing Medicine data breach class action lawsuit.

Under the terms of the Modernizing Medicine settlement, class members can receive a cash payment and two years of free credit monitoring.

Class members who experienced documented losses as a result of the data breach can receive up to $5,000 in compensation. These payments will cover losses, such as identity theft, fraud, credit-related fees, costs to replace IDs and postage to contact banks by mail.

Class members who did not experience documented losses can receive a one-time estimated payment of $75. Exact payments may be higher or lower depending on the number of claims filed.

All class members are eligible for two years of free credit monitoring through CyEx Medical Shield Complete. This service includes $1 million in identity theft insurance, real-time monitoring, dark web scanning and more.

The deadline for exclusion and objection is Oct. 19, 2026.

The final approval hearing for the Modernizing Medicine settlement is scheduled for Nov. 17, 2026.

To receive settlement benefits, class members must submit a valid claim form by Nov. 2, 2026.

Potential Award

Up to $5,000 in documented losses or an estimated $75 cash payment

Proof of Purchase

Reasonable supporting documentation, such as telephone records, correspondence or receipts. Self-prepared documents, such as a personal certification, declaration or affidavit, can be included to provide clarification or context.
