$117M pork price-fixing class action settlement

Pork producers agreed to pay more than $117 million in a class action settlement to resolve claims they conspired together to raise the price of pork products.

The pork settlement benefits consumers who purchased raw pork bacon or one or more of the following types of raw pork (fresh or frozen) made from bellies, loins, shoulder, ribs or pork chops from Agri Stats, Clemens, Hormel, JBS, Seaboard, Smithfield, Triumph, Tyson or other co-conspirators in certain states between June 28, 2014, and June 30, 2018.

States included in the settlement are Arizona, California, the District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah and West Virginia.

Plaintiffs in the pork price-fixing lawsuit accused pork producers of working together to raise and fix the price of pork products. As a result of this scheme, consumers allegedly paid more for pork products than they otherwise would have in a competitive market.

Clemens, Hormel, JBS, Seaboard, Smithfield, Triumph and Tyson sell pork products to grocery stores, restaurants and other businesses. Agri Stats is a data sharing and consulting company that collects and distributes pricing data to processors and meat buyers.

The pork producers have not admitted any wrongdoing but agreed to a $117.065 million class action settlement to resolve the price-fixing allegations. This settlement is in addition to previous settlements with JBS and Smithfield, which totaled $95 million.

Under the terms of the pork price-fixing settlement, class members can receive a cash payment based on the amount they paid for pork products during the class period. Class members who purchased more products will receive a larger share of the net settlement fund. Exact payments will vary.

The deadline for exclusion and objection is Oct. 29, 2026.

The final approval hearing for the pork price-fixing class action settlement is scheduled for Dec. 11, 2026.

To receive settlement benefits, class members must submit a valid claim form by Oct. 29, 2026.

Who’s Eligible

The class action settlement benefits consumers who purchased raw pork bacon or one or more types of raw pork (fresh or frozen) made from bellies, loins, shoulders, ribs or pork chops from defendants or co-conspirators between June 28, 2014, and June 30, 2018, in the following states: Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah and West Virginia.
