DoorDash fees class action lawsuit overview:

  • Who: A Maryland federal judge extended the discovery period for a class action lawsuit against DoorDash Inc.
  • Why: Consumers claim DoorDash charges unlawful fees to its users, delivery drivers and restaurant merchants.
  • Where: The class action lawsuit was filed in Maryland federal court.

A federal judge in Maryland granted a motion to extend the discovery period for a class action lawsuit against DoorDash claiming the food delivery service charges unlawful fees. The deadline is now Feb. 16.

In a complaint filed against DoorDash last September, a group of consumers claim the company charges fees to its delivery drivers and restaurant merchants that cause consumers to “bear the unsettling burden of the increased cost.”

“Because DoorDash’s hidden fees (which include hidden commission, marketing, sponsored listing and credit card transactions fees) reduce profit margins on food orders, restaurants must increase their prices,” the DoorDash class action states.

The group of consumers claim DoorDash also charges users a variety of misleading and deceptive fees, including so-called “city” fees that “create the illusion for consumers that local governments impose these fees on orders.”

DoorDash charges delivery fees despite not performing deliveries, class action claims

DoorDash charges its users a number of delivery fees despite the company allegedly not conducting the deliveries themselves, the DoorDash class action alleges.

“DoorDash’s fees are deceptive, misleading and otherwise fraudulent. DoorDash promises services that it does not provide, including charging consumers a premium amount for deliveries that DoorDash does not perform,” the DoorDash class action states.

Consumers want to represent a nationwide class of DoorDash users who were “inappropriately and illegally charged” by paying any combination of a delivery fee, express (or priority) delivery fee, extended range delivery fee, marketing fee or commission fee after placing an order on the DoorDash app or website.

The class action lawsuit claims DoorDash is guilty of unjust enrichment, negligent misrepresentation, fraudulent concealment, fraud or deceit and violations of the Racketeer Influenced and Corrupt Organizations Act, among other things.

The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of monetary and treble damages for themselves and all class members.

In JUly 2022, a consumer filed a separate class action lawsuit against DoorDash, arguing the company falsely advertises it charges no delivery fees despite adding fees in the prices of items purchased for delivery.

The plaintiffs are represented by Thomas R. Bundy, III, Leslie J. Bryan, Lovita Tandy and Andrew D. Herman of Lawrence & Bundy LLC.

The DoorDash fees class action lawsuit is Hecox, et al. v. DoorDash Inc., Case No. 1:23-cv-01006, in the U.S. District Court for the District of Maryland.

I’ve contacted DoorDash on multiple occasions asking why the mileage was higher than what I originally accepted. They blew me off every single time. I’ve been doing this for 3 to 4 years and I’m so happy that this is being dealt with properly. I never received my claim number so I need to get in touch with someone to set this up bs this has affected my life for years of deception and theft

My son and I own a pizzeria in Davenport Fl. We have been doing business with DoorDash for years. They send us food orders, we make the food, their drivers collect the food for delivery. Since September 2024 they stopped paying us for food orders being made. We contacted DoorDash support many times, you talk to a different person every time and all they say is they will escalate the claim to higher authority and they will call us back which they never do. The total amount outstanding is $28,728.76 of which they paid $6864.08. They informed us that that is their final decision. According to them our bank detail was changed. They did not inform us and we did not request them to change any information. Frankly I don’t believe them and it is not possible to talk to any DoorDash decision makers.

Well, isn’t that sweet? I work for doordash and for Uber Uber eats and I’ve never been so upset in my life to run around looking for college student dorm entrances, poor directions that lag making me miss turns, and they hit you with $1 and $2 deliveries that are in this economy a severe waste of time and gas. But the two worst parts of this company’s treatment of ‘independant contractors’ is that the popup gives you no information about tips. They ALL say “expected tip”. And they claim that we get 100% of them. Lol how would we know? When ordering a delivery, the tips are added at the payment step. When I asked about that- they said they can’t tell us the tip into the payments have gone through bc the customer has the option to remove the tip after delivery. I’ve never had that option when ordering delivery. Also-there’s no way that I’m making half of minimum wage per hr. And this is not funny to me. Top all of that off with a bogus support system that penalized me for not delivering the order bc the restaurant did not have the item. AND I have to pay taxes gas vehicle maintenance and gel told how long I sat in one area before hitting a button in the app. I’m LIVID bc I’m wasting my time delivering in the cold weather, but twice have nearly ran out of gas bc I can’t even afford to fill up with what I’m making yet. They’re robbing everyone. Uber eats does the exact same thing.

Is this still going on. I’ve used them over 3 years and still have access to account. I also noticed it depends on type of card you use the end total is different

  6. Teresa says:

I did a recent order for Wendy’s. The driver never showed up. I look in at the app and the driver was a few miles away at a hotel. DoorDash said it would give me 26 in credits. The problem is I spent 34 dollars. DoorDash was going to try pocket 8 dollars from me. It’s not my fault that the driver did not deliver and went to a hotel instead. Then they finally offered me the whole 34 dollar credits. When I got off the chat they didn’t issue the credits so that I can do a replacement order. This company commits Fraud on consumers and its drivers

  7. Renarta Mack says:

DoorDash got me yesterday and today for double charges and i have the proof and showed them the proof and they refuse to give me my money back which is almost 75 dollars and they refuse to help. I went all the way up to a supervisor and they did not nothing. I emailed the so called ceo and he never responses. THey dont care. I want my money back. PLEASE ADD ME TO THE CASE AS WELL
