Charter Cable TV Class Action Lawsuit Overview:

  • Who: Charter cable TV customers are suing the company Charter Communications Inc. over an alleged bait-and-switch scheme, but four of the five plaintiffs have been forced into arbitration
  • Why: A judge said the plaintiffs did not specifically opt out of the arbitration agreement
  • Where: The case is being heard in a Connecticut federal court

Only one of five Charter cable TV customers who allege the company tricked them with a “bait-and-switch” scheme with hidden fees may go ahead with a class action lawsuit, a Connecticut federal judge has ruled. 

In an order filed Jan. 14, U.S. District Judge Charles S. Haight Jr. ruled that four of the named plaintiffs in a class action lawsuit filed against Charter Communications Inc. in 2020 must resolve their claims through arbitration — outside of court.

He agreed with Charter’s supplied documentation that most of the plaintiffs had agreed to the company’s General Terms. 

“The record shows that Plaintiffs Kleuskens, Weber, Foster-Harper, and Kinell all assented to the arbitration provision by clicking “I Agree” when presented with electronic versions of the General Terms,” he wrote. 

“These plaintiffs also assented to the agreement by continuing to use and pay for Charter’s services after receiving notices on their billing statements.”

Only Randall Byrne will be allowed to stay and lead the class action because he was the only one to specifically opt out of the arbitration agreement that the rest agreed to. Byrne must wait for the arbitrations to conclude before he continues with the class action, Judge Haight ruled, as the arbitration may overlap with the case.

The Charter customers filed the class action lawsuit in May 2020, saying that the communications company misled its customers about the costs of its Spectrum cable television services.

The customers, all of whom have Spectrum TV subscription with Charter, allege the company deceptively increases the monthly rate, charges undisclosed fees, reduces the number of channels included in its packages, and makes it hard for customers to cancel their service subscriptions. 

The plaintiffs say that they were all offered a lower monthly rate that was then raised, contrary to what the company advertised.

The customers all present similar stories of how the company implanted a “bait and switch” scheme that led to them paying more than was advertised when they decided to purchase subscriptions.

    According to Spectrum’s TOC-if a customer cancels during month, they’re responsible for entire month svc.
    I didn’t cancel-I moved-I transferred Spectrum svc to new location, but they’re charging me for entire
    month at previous location. Total rip off-and not unique. There is POWER in numbers…let our voices be heard!

    Please add me, spectrum has lies and arr cheating me for more money, our plan was suppose to ne 101 Dollard a month, I called several times to straighten this out I get a different lie everytime, I paid my bill they want another 98.00 extra this month plus our monthly bill which is not the agreement it suppose to be.. they are putting in charges that was never put in the original agreement they never gave up a due date nor did they send a bill, when I called about the bill as to why they haven’t sent yet and when I got the bill it was over 265.00 they are scamers and lies we Re on fixed incomes and they have charged us over what we were suppose to pay, we can’t afford it, it’s sad amd there customer service representative have no care for your complaints at all, they never offer to assist you with any pliable help, they’re like robots with no emotions.. they told me we made no payments since we had the bill but yet read off to me what we paid, we have statements of out bill and er only had the service since September 2022, and they continue to charge me me am extremely 98.00.. so please add me as well..Thank you for your time.

    Please add me, there is no internet option other than Spectrum in our area. There service is awful, constant interruptions. Unexplainable fees and plans always go up in price.

    Please add me. I cancelled and returned their equipment with documentation, but they insist I pay them a month subscription fee after I had cancelled my service.

    I’m going through hidden fees now(9/13/2022), every month my bill goes up for no reason. I pay my bill in the MySpetrum app. I pay what the amount is every month in full. I called them and they have put extra charges in my account and said I had a previous balance-I refuse to pay $200 a month for TV and there’s nothing new to watch, just repeats on every channel everyday.

    Please add me. Spectrum is charging me for an additional month after I canceled and switched to another company. Instead of turning off my service, they upgraded me to more channels. They lied to me twice on the phone and once in the store when I returned their gear.
    Bad Faith in Business, where is my $5000 in damages.

    I have been with Spectrum for several years now since it’s the only provider in my area, I pay $256/month for just TV and Internet, but everytime I try to cancel, they say I have to pay it again before they can make any changes and then I was approved for the $30 internet discount thru covid relief help, so then my bill with the discount is now $276, so please tell me how that is supposed to help? They add another $50 to my bill for me to get a $30 discount? Completely backwards, but since only provider, they know people are stuck paying, the excuse I always get is that my discounted rate has expired, when did I ever get a discounted rate? Price gouging from hell. I pay more for Spectrum than I do for my car payment.
