AXS class action lawsuit overview:

  • Who: Plaintiff Rahul Sawhney filed a class action lawsuit against AXS Group LLC.
  • Why: AXS allegedly violates New York law by failing to disclose fees for tickets before the customer reaches the final checkout screen.
  • Where: The AXS lawsuit was filed in California federal court.

A new AXS class action lawsuit accuses the ticket seller of “nickel and diming” consumers who buy tickets to various entertainment events in the state of New York.

Plaintiff Rahul Sawhney says consumers who browse the AXS website or mobile app are quoted a price without fees, “only to be ambushed” with hefty service charges when they reach the checkout screen.

The plaintiff points to a law passed by New York lawmakers in 2022 that requires ticket sellers to disclose the total ticket cost, including fees, prior to the ticket being selected for purchase.

The law specifically states the ticket price “shall not increase during the purchase process,” according to the AXS lawsuit.

AXS fees not disclosed until final checkout page, plaintiff says

When consumers visit the AXS website or app to search for tickets to an event in New York, Sawhney says they are presented with a screen that lists prices for various seats in the venue.

However, when the consumer selects a ticket, the ticket review page discloses the ticket is actually the listed price plus taxes and AXS fees, Sawhney alleges.

After clicking the checkout button, the consumer is prompted to sign in or create an account before reaching the final checkout screen disclosing the actual total amount of the ticket plus fees, the AXS lawsuit alleges.

Sawhney claims AXS tricks consumers by exploiting their desire to complete a purchase once they have initiated the process and selected seats. By forcing them to click through several screens, the website designer forces consumers to invest time in the transaction and they will be more likely to complete the purchase even after seeing the fees, Sawhney asserts.

Sawney seeks to represent a proposed class of consumers who purchased tickets from the AXS marketplace to events in the state of New York on or after Aug. 29, 2022.

Last year, Taylor Swift fans filed a class action lawsuit against Live Nation and Ticketmaster for allegedly charging exorbitant fees.

    I purchased 4 “VIP” tickets through AXS for the Tina Fey and Amy Poehler show at Red Rocks on May 1, 2025. I believe it was a Live Nation event. Included in the cost of the tickets were VIP early entry “meet and greet” experience (which didn’t exist), and “free” merch code…. Which didn’t work. I was enticed into spending $2,228.84 on these tickets for the VIP and free merch which didn’t exist. To me, this is fraud. I reported this to the state AOG office.

    I paid 615.50 November 28, 2024 for tickets to cirque du Solei in Colorado springs for April 24, 2025 and they say they sent me tickets to the App i installed and I have never received them. I wanted to cancel as I have spent several hours on hold and talking to them and they refuse to refund me. I should be able to download and print tickets to show at the door of the venue and they say they cant accommodate paper tickets. I want to be a part of any lawsuit. Wish I would have read the review before I purchased these expensive tickets.

    Please add me as well, not only the fees, but the tickets were not delivered on multiple occasions this year and they claim my “private relay” email is the issue when I have 6 other tickets purchased last year using the same information. $400 worth stolen and they blame my email. I have contacted Axs and Axs market place, they say that I need to call the other almost every time and nothing is resolved. I have several emails, and purchase statements to back up my inquiry, including past tickets using the same email that the tickets got delivered to.
