Antigua Club agreed to pay $190,000 to resolve claims it charged tenants unlawful termination fees without providing the required notices.

The settlement benefits individuals who leased residential properties from Antigua Club in Florida and whom the club charged liquidated damage fees without a lease expiration notice that listed all fees, penalties and other charges since March 9, 2019.

According to plaintiffs in the case, Antigua Club violated the Florida Residential Landlord and Tenant Act (FRLTA) by charging termination fees on vacating tenants at The Grand Reserve at Lee Vista. Plaintiffs argue Antigua Club failed to send the required notices before charging these fees, which they say amounted to unlawful liquidated damages.

The Grand Reserve at Lee Vista is an apartment complex in Southeast Orlando, Florida. 

Antigua Club hasn’t admitted any wrongdoing but agreed to a $190,000 settlement to resolve the FRLTA allegations.

Under the terms of the settlement, Antigua Club will forgive $119,517 in termination fees the former tenants allegedly owe. The settlement also provides statutory damage payments and refund payments, though these amounts will vary between class members. Class members can check their estimated award on the settlement website.

The deadline for exclusion and objection is June 30, 2024.

The final approval hearing for the settlement is scheduled for July 16, 2024.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
