Nordstrom, Experian, TD Bank Credit Report Class Action Lawsuit Overview: 

  • Who: Christine Harris filed a class action lawsuit against Experian Information Solutions, Nordstrom, and TD Bank USA. 
  • Why: Harris alleges Experian failed to properly investigate her dispute of accounts sent to the credit reporting agency by Nordstrom/TD Bank. 
  • Where: The class action lawsuit was filed in New York federal court.

Experian violated the Fair Credit Reporting Act (FCRA) by failing to correct an erroneous credit report sent to them about a Nordstrom credit holder, a new class action lawsuit alleges.

Lead plaintiff Christine Harris claims Nordstrom and TD Bank sent false and inaccurate information about her credit to the credit reporting agency Experian, which proceeded to ignore her disputes and issue a credit report with the incorrect information. 

Harris wants to represent herself and a New York Class of consumers who notified Experian of an account dispute that then failed to show up on a subsequent credit report within the past two years. 

Plaintiff says Nordstrom and TD Bank sent Experian inaccurate information claiming she had $82 written off in her credit account and that she’d previously filed for bankruptcy. Harris sent a letter to Experian to dispute the information, but the company issued a credit report with the false information anyway, says the class action lawsuit. 

“Despite the dispute from the Plaintiff, Experian has completely abdicated its obligations under federal and state law and has instead chosen to merely ‘parrot’ whatever its customer, Nordstrom/TD has chosen to say,” the class action lawsuit states. 

Nordstrom and TD Bank violated its promise in its subscriber agreement to accurately update its customer accounts, Harris said. She also claims the defendants “willfully, maliciously, recklessly, wantonly, and/or negligently failed,” to follow its contract as well as the laws set forth by the FCRA. 

The FCRA requires furnishers to conduct thorough examinations of a customer’s transaction history before responding to debt inquiries, according to the class action lawsuit. Harris alleges that by sending a letter to Experian disputing Nordstrom/TD Bank’s account, the credit reporting agency needed to conduct a “reasonable investigation,” into her dispute, but they failed to do so, the class action lawsuit claims. 

According to the lawsuit, “if Nordstrom/TD had performed a reasonable investigation of Plaintiff’s dispute, Plaintiffs matter with Nordstrom/TD would not have been reappeared under a different account number in the Plaintiffs report.”

Harris is requesting a jury trial where she is seeking actual damages, punitive damages, and statutory damages for herself and all Class Members. 

A similar class action lawsuit was filed against Nordstrom in 2016 that claimed it violated federal law by failing to properly disclose the method of its “returned payment fee.” A federal judge later dismissed the class action lawsuit. 

The clothing retailer had another class action lawsuit filed against it back in 2017 that alleged it  broke the law by authorizing temporary charges on customers credit cards

    25 year nordstrom card holder just had my card closed because of Experian’s inaccurate reporting to Nordstrom. I’ve never been late on payments or been over limit. Nordstrom even increased my limit by over $2,000 a few months ago. I’d love a lawyer to take this case
