JPMorgan Chase fails to adequately protect and reimburse its customers from fraud originating from the digital payments network Zelle, a new class action lawsuit alleges. 

Plaintiff Melinda Glavin claims Chase, which partially owns Zelle, refused to reimburse her for an allegedly fraudulent $6,500 transaction after determining that the payment in question had come from her phone.

Glavin argues she was debited through her Zelle application — which was linked to her Chase account — without her permission, and that the incident was another case of Zelle fraud she says Chase is failing to address. 

“Defendants have not taken adequate steps to protect consumers from Zelle fraud, which often results in substantial losses to individual consumers and customers of Chase,” the Zelle class action states. 

Glavin wants to represent a nationwide class and Pennsylvania subclass of Chase customers who have had their accounts debited via an unauthorized transaction from Zelle, and who was not permanently credited by Chase in full within 45 days of filing a dispute. 

Chase ‘doing virtually nothing’ to stop instances of Zelle fraud, says class action

Glavin claims Zelle is “a favorite among fraudsters, thieves, and hackers,” thanks to the immediacy of its services and the fact there is “no way for a user to retract a payment.” 

The issue, Glavin argues, led a trio of US Senators to write a letter to Zelle’s bank owners, calling them out for “failing to do enough to prevent fraud on their peer-to-peer system.” 

“Banks, however, including Chase, are aware of the widespread fraud on Zelle but are doing virtually nothing to stop it and little to nothing to help consumers get their money back,” the Chase class action states. 

Glavin claims Chase is guilty of negligence and of violating the Electronic Fund Transfer Act. She is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual and treble damages for herself and all class members. 

A similar class action lawsuit was filed against Bank of America earlier this year by a consumer arguing the bank allowed unauthorized withdrawals from customers accounts that originated from Zelle.

    Someone pretending to be a Public Defender said he was the public defender assigned to my brother’s case and that he needed between $1000 to $1500 to bond my brother out. My uncle and I gave he a total of $1100 via Zelle/Chase.

    I was scammed and the person who scammed me logged into my account and zelled $9,101.98 and Chase Bank won’t refund my account. They said it was authorized. It’s a huge mess. I don’t even use zelle is the crazy thing! I was told to contact the FBI and that I would have to settle it in court and then was hung up on by a supervisor at chase bank.

    I was scammed two days ago (Aug 30th, 2023) on Facebook Marketplace. I have never used Zelle and paid $500 for a non-existent transmission that the guy said he would send me. He was a professional because he knew everything about the transmission I wanted and even offered to throw in adapter plates. Once paid, he disappeared into thin air. My bank refused to pay and Zelle said they would report it into the black hole. No recourse. Include me in this lawsuit. Zelle is negligent in advising customers of the dangers. There should be a huge notice when you hit pay that says you are not covered if scammed and never ever pay through Zelle to someone you don’t know. But that would decrease transactions and profits for the behemoth banks behind Zelle.

      I was scammed through Zelle for $3000 in July of 2023 from my Chase bank account and informed by Chase there wasn’t anything they could do!!

    I am very frustrated. I was scammed $500 via Zelle just the other day from a purchase made on Facebook Marketplace. I met him in person and found out after depositing the money into his account that the item that i had purchased was unusable. I contacted Chase and they put a fraud alert on my card. They told me that they had to cancel my card for protection. They also promised me that the funds would go back into my account immediately and that I was protected . I now have a iphone that is unusable due to non payment. Chase should protect their customers. I will file a police report… I have screen shots of the person that sold me the phone , I even called the Wireless provider and got the info needed to go after this scammer….. very frustering

    I scammed out of $200 yesterday (8/13/2023). I don’t typically use any of these apps (Zelle, Cash App, etc) but I trusted it since it was a service connected with my bank. I made a payment for something and both my bank as well as Zelle pretty much said “oh well”. I am furious that a company wouldn’t have fraud protections in place especially because of the world we live in. I am even more furious at my bank for being connected to such a company that has the potential to scam its customers without consequence!

    On October 28, I received a 1-800 call alerting me that funds were being withdrawn from my account and that an urgent response is needed. I was unaware of Zelle fraud, as I do not use Zelle often. I’ve not had it for too long. The caller identified himself as a Wells Fargo employee. He sounded very convincing as he informed me that my account was being overdrawn by someone at Walmart. He even gave me a name. He told me that my money was being withdrawn as we speak and immediate action is needed. He then proceeded to instruct me on how to get these funds back into my account. I was completely unaware that I was being scammed. I was distraught and literally was “freaking out”. Everything seemed legitimate as the caller, was able to place his then “fraudulent supervisor’s name of my Zelle account and convince me to transfer funds back into my account. I am always the only one who could put a name on my Zelle accounts. So, I had no reason to believe this was not a Wells Fargo employee. He stated that his supervisor would assist in getting the funds back into my account. . I was scammed out of over 2,000.00 Wells Fargo stated that this was truly a scam but that Chase bank would not release the funds to get my money back and there is nothing that can be done. I would like to get in on a Class Action suit against Chase Bank and Wells Fargo.

    I was scammed by someone who created an account and had me on the phone said they were with Amazon as I called a phone number thinking it was Amazon then it led to Zelle etc even had chase on phone and they didn’t block it.’
    Fraud department did nothing as the account was with Zelle and a name I even had phone numbers and I texted the guy he even texted me!
    He wanted more money and wasn’t afraid of chase at all. I still hav phone numbers.
    This was in 2022 and lost about $500! A lot for me and want to do lawsuit against chase!
