Dabur International Ltd. d/b/a Dabur USA Inc. sells over-the-counter hair straightener and relaxer products that contain endocrine-disrupting chemicals that are known to increase women’s chances of developing significant health problems, a class action lawsuit alleges.
Plaintiffs Carla G. Rose and Dollie Dillon filed the Dabur hair-relaxing class action lawsuit Nov. 16 in Illinois federal court. They claim they would not have purchased Dabur hair-straightening products if they had known that they may contain endocrine-disrupting chemicals.
Endocrine-disrupting chemicals (EDCs) are known to increase a woman’s risk of developing many potential health issues, including but not limited to endometriosis, reproductive organ abnormalities, various cancers, respiratory issues, diabetes, obesity and cardiovascular problems, the Dabur relaxing products class action explains.
Dabur sells hair relaxers and straighteners under various brand names, including ORS Olive Oil. The plaintiffs both claim that they purchased ORS Olive Oil products because they believed that they were “unadulterated, safe and effective.”
Rose and Dillon argue that Dabur did not disclose the presence of EDCs on the products’ labels as required by state and federal law.
FDA prohibits selling adulterated products without warning label, Dabur relaxing class action says
Hair straighteners and relaxers are marketed to women to make their hair smoother and easier to manage. The product is applied to the base of the hair shaft and left in place for a period of time.
The hair-straightening process must be repeated every few weeks to smooth the new growth of hair. Many women repeat this process every four to eight weeks over a period of decades, the Dabur relaxing products class action says. During this treatment, the body absorbs chemicals in the hair relaxers through direct skin contact.
Although the FDA does not need to approve cosmetic products and ingredients before they go to market, the agency prohibits the marketing of “adulterated” or “misbranded” cosmetics in interstate commerce, the plaintiffs say.
Product makers are responsible for assessing the safety and efficacy of their products and warning consumers if a health hazard may be associated with the product, the Dabur relaxing products class action alleges. Rose and Dillon claim that Dabur failed to warn consumers that their products may contain EDCs, potentially putting their health at risk.
The plaintiffs would not have purchased the products if they had known that there was a risk they may contain EDCs, the Dabur hair-relaxing products class action lawsuit alleges.
The plaintiffs ask the court to provide medical monitoring for class members who have used the Dabur products.
If you are a woman who developed uterine cancer after using hair-straightening products, you may qualify to participate in a hair-straightening lawsuit investigation.
The plaintiffs are represented by E. Samuel Geisler of Aylstock Witkin Kreis & Overholtz PLLC.
The Dabur hair-straightening class action lawsuit is Carla G. Rose, et al. v. Dabur International Ltd. d/b/a Dabur USA Inc., et al., Case No. 3:22-cv-02686, in the U.S. District Court for the Southern District of Illinois.
