A Colorado woman is suing Bayer Healthcare Pharmaceuticals Inc., alleging that she suffered a stroke caused by a blood clot from Yaz birth control.
According to the birth control lawsuit, Brigette Russell began taking either Yaz, Yasmin or Ocella beginning in April 2010. On Dec. 28, 2011, she was reportedly diagnosed with Yaz stroke side effects and stopped taking the oral contraceptive. She was allegedly unaware of any risks involving the medications prior to the stroke.
On the other hand, her Yasmin lawsuit attorney alleges that Bayer should have known by then that there was an increased risk for blood clots from Yasmin and Yaz, which could lead to a stroke, pulmonary embolism and similar problems throughout the entire oral contraceptive family. While the science is ultimately unclear about the cause of birth control blood clots, numerous studies beginning in the early 2000s demonstrated a link between the medications and clotting concerns.
Instead, according to the Yaz lawsuit, Bayer reportedly advertised that it was safe to use and had minimal side effects. The U.S. Food and Drug Administration twice sent letters regarding these commercials, resulting in the drug maker having to run corrective advertisements. The second warning specifically noted the lack of information regarding blood clotting issues that, in addition to stroke, can also cause deep vein thrombosis and pulmonary embolisms.
Russell is seeking damages on counts of strict products liability, negligence, breaches of express and implied warranties, fraud and violation of state statutes.
