xAI class action lawsuit overview:

AA new class action lawsuit accuses the artificial intelligence (AI) chatbot Grok, created by xAI, of sexually exploiting women and girls by creating non-consensual deepfake images of them in sexual positions.

Plaintiff Jane Doe’s xAI class action lawsuit claims the AI chatbot Grok humiliates women and girls by undressing them and posing them in sexual positions in deepfake images publicly posted on X.

The plaintiff argues the non-consensual revealing and sexual deepfakes created by Grok can never be erased, have seriously harmed the women depicted and place them at risk of further future harm.

“AI makes manipulating images and videos of real people to realistically portray fake situations as easy as typing in a prompt and hitting a button,” the xAI class action lawsuit says.

Doe wants to represent a nationwide class and South Carolina subclass of individuals who, within the statute of limitations, were depicted in sexualized or revealing deepfakes created and disseminated by Grok without their consent.

Lawsuit: xAI failed to implement safeguards despite knowledge of deepfake use

Doe argues xAI failed to implement safeguards to prevent Grok from creating non-consensual deepfakes, despite the fact that the company knew its AI chatbot’s image generation functionality was being used to create the deepfakes.

“Defendants knew or should have known that Grok’s image generation functionality was used to create such deepfakes,” the xAI class action says.

Doe claims xAI is guilty of strict liability, negligence, public nuisance, defamation and intentional infliction of emotional distress, among other things, and is in violation of California’s Unfair Competition Law and the state’s statutory right of publicity.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, presumed, statutory and punitive damages for herself and all class members.

In other AI lawsuits, Google is facing allegations it secretly turned on its Gemini AI program for all users’ Gmail, Chat and Meet accounts, thus enabling AI to track users’ private communications without their knowledge or consent.
