Worker Files Lawsuit After Long Term Disability DeniedA worker who alleges that she experienced long term disability denied despite filing a legitimate claim has lodged a lawsuit against Unum.

Plaintiff Edwige F. has initiated a long term disability denied lawsuit. She alleges that Unum is responsible for the circumstances of having her long term disability denied unfairly.

She alleges in the long-term disability denial lawsuit that Unum unfairly denied her the benefits she would require in order to move on with her life after developing a disability. In August 2016, at the time the plaintiff was employed by a hospital, she alleges she was entitled to disability coverage through the employer.

When Edwige allegedly suffered an accident in August of 2016, she says she was forced to discontinue working immediately and initiated a voluntary benefits claim to receive the compensation she thought she was owed under the policy terms.

After lodging the voluntary benefits claim, she says that the experience of having her long term disability denied left her without the critical benefits to be able to pay her bills or to recover after suffering a disabling injury.

The initial experience of having her long term disability benefits denied led her to file an appeal with Unum. The appeal of the denial included information shared by the plaintiff that she was actively pursuing numerous medical records that attested to her disability and was coordinating that effort with the physicians’ offices involved.

The plaintiff also shared with Unum, the disability insurance company, that she would provide those records to the insurance carrier as soon as she came into possession of them and requested that the insurance carrier not reach a final decision about her appeal until she was able to obtain and submit the physician’s records.

Despite this request, however, Edwige says she received a final denial letter was issued which denied the plaintiff the fair and full review that was guaranteed by the federal act, ERISA.

According to the long term disability denial lawsuit, Unum made its final claim decision while operating through a conflict of interest which significantly impacted the defendant to deny the plaintiff’s claim.
