The talc powder lawsuits are currently pending as a multidistrict litigation in a federal court in New Jersey. There are more than 4,800 cases in that multidistrict litigation pending against Johnson & Johnson.
The judge responsible for that MDL is anticipated to put together a bellwether program in which small groups of representative cases will be prepared for early trial dates to determine how a jury is likely to respond to testimony and evidence that is most likely going to be repeated over the course of the litigation.
The discovery process has already been completed in many of these talc powder lawsuits. Investors may already be concerned about the potential impact of the internal documents released by Johnson & Johnson. This may impact the stock value for the company.
The concerns are centered upon whether or not the company knew about the potential risk of ovarian cancer development after usage of talc powder. One 1974 memo was concerned about the use of chrysotile asbestos in talc and called for the use of an alternative.
The company, in response to the talc powder lawsuits, says that going back to 1972, no traces of asbestos were found in the talc powder products they produced. Previous concerns about talc powder had to do with constant exposure to asbestos that could lead to mesothelioma, a cancer diagnosis for which there is no cure.
A California jury recently awarded more than $17 million in compensatory damages and more than $4.5 million in punitive damages to the family of a man who died after years of exposure to talc. He ultimately passed away as a result of mesothelioma.
